18. On Roberts, not enough was known to really fight him
On ALito, Kerry and Kennedy worked hard to filibuster him, but the Democratic leadership was not solidly behind it - actually speaking informally against it.

6. Let's be glad things are the way they are
The way the Democrats luck goes sometimes, McGrumpy would have passed away awhile ago from all the stress, and President Palin would be appointing Tom DeLay or Newt Gingrich to the SCOTUS this summer. And Vice-President Michelle Bachman would administer the oath of office, as mentioned to the press by the White House press secretary Sean Hannity.

Would that thought be enough to make you sick?

12. my guess is that souter and stevens would have delayed their retirements.
i suppose it's possible that one of the conservatives might have chosen to retire with a republican in the white house, but i'd expect them to try to hang on.

regardless, i'm very pleased with sotomayor and am hopeful for obama's second pick.

I think Sotomayor was a great choice, and he has some momentum going here. But I'm still afraid he'll try and appoint a "moderate".

Souter may have delayed his retirement, but Stevens is 90 already. I don't know how much longer he could have held on.

15. i sure hope not. a court pick is the one area where there's no clear appeal to bipartisanship
any decent-sized piece of legislation has a ton of deal-making in it, so there's some appeal to bipartisanship (presuming that the other side is acting in good faith, anyway).

but a court pick is a court pick is a court pick. it's not like a bill where you can just toss in a position that appeals to the other side, or more money for their district or state.

the only kind of nod you can give to the other side is, e.g., not picking someone who's views on abortion are already well known. this has been the idiotic nomination hearing dance of late where nominees interview for a life-tenured job by revealling as little as possible about anything they might ever do in that capacity.

17. This POTUS has the potential to choose 3 justices. McCain's health would've failed under the strain
... of the Presidency, and that would have left us with President Palin making the decision. How anyone in their right mind could claim it makes no difference is beyond me.

If we are unbelievably fortunate, one of the radical RW justices will have some of those RW imprecatory prayers rebound on him and Obama could get a fourth pick. But I'm not holding my breath.
