Judge Sidney Thomas, U. S. Court of Appeals for the Ninth Circuit
Nominated by William J. Clinton on July 19, 1995
56 Years Old

WASHINGTON – President Barack Obama's candidates for the Supreme Court include a new name, federal appeals court Judge Sidney Thomas of Montana, and at least six others who were considered contenders when Obama chose his first high court nominee last year, The Associated Press has learned.

Among the others under consideration are former Georgia Chief Justice Leah Ward Sears, federal appeals court judges Diane Wood and Merrick Garland, Solicitor General Elena Kagan, Michigan Gov. Jennifer Granholm and Homeland Security Secretary Janet Napolitano.

The president is seriously reviewing about 10 people as a potential nominee to replace Justice John Paul Stevens, who is retiring this summer.

Seven of those names are now confirmed to the AP by the admistration.

A senior administration official said the president's consideration is not just centered on the three people receiving the most public attention: Wood, Kagan and Garland. The official spoke on condition of anonymity because no announcements have been made about the people Obama is considering for the court.

6. Not old enough.
I get the point... But you can't rely on someone's judicial/political philosophy to remain where it was in their 20s.

10. Appeals court tosses out 111 death sentences in 2003, Thomas authored the ruling:
WASHINGTON (CNN) -- Citing a 2002 Supreme Court ruling that only juries can impose the death penalty, a federal appeals court overturned 111 death sentences Tuesday that had been imposed by judges in Arizona, Idaho and Montana.

In an 8-3 vote, the 9th Circuit Court of Appeals in San Francisco, California, said inmates sent to death row by judges should have their sentences commuted to life in prison. ..

12. The 9th is one of the best --
circuits in the country -- pretty consistantly forewaed looking as jurists. Many of their decisions have later been overturned. Now I have to look at where this guy has voted on some of the bigger cases they have looked at.
