Attorney For Birther Army Doc Is Former GOP Staffer And Anti-Gay Crusader
The attorney driving the story of the Birther Army doctor facing a court martial for refusing orders is a former Republican Hill staffer and current personal injury lawyer who has dabbled in anti-gay activism and reportedly wrote a letter to the FBI tipping off the feds to New York Gov. Eliot Spitzer's use of prostitutes, months before the scandal publicly broke.

Attorney Paul Rolf Jensen runs a California law firm, Jensen & Associates, that focuses on bread and butter personal injury cases involving dog bites, seatbelt failure, and asbestos exposure.

But, says the GOP operative Roger Stone, a friend and sometimes client of Jensen's, he should not be underestimated when it comes to the case of Lt. Col. Terrence Lakin.

An Army doctor, Lakin believes President Obama may not be a natural born citizen, and therefore that military orders are invalid. He was charged last week for refusing orders to show up to be deployed for a second tour in Afghanistan.

"Jensen is a bulldog. A true student of the law. A brilliant litigator. Not adverse to high profile cases and high risk legal strategies," says Stone in an email. He "understand(s) public relations and the damage this case can do to Obama. Won't be adverse to trying to call Obama for testimony."

In an appearance with Lakin on the G. Gordon Liddy show last week, one of several media appearances, Jensen hinted that he will try to use discovery to compel Obama to release a birth certificate.

Also like Hemenway, who once filed a complaint against her daughter's first grade teacher because the teacher announced she is a lesbian, Jensen has been involved in anti-gay activism.

Jensen had filed "25 charges of heresy" against other Presbyterians around the country, CNN reported in 2004. The complaints included cases in which pastors officiated over same-sex unions, ordained gay elders, or were themselves gay.

"I am called to action within the Presbyterian church to fight back against those who have made war and would destroy our church," he told CNN.

For his work, though, he will be handsomely paid. The American Patriot Foundation estimates in a new fundraising pitch that Lakin's legal bills will top $500,000.

1. Not surprised. My teabagger sisters and their husbands are disgusting homophobes.
And they're racists. And they're fundamentalists. So I'm not surprised to see one of their fellow homophobes defending this cowardly POS.

I swear, Meeg, I don't know if I will be able to get together with my family this summer. Their hatred comes through constantly. I don't know what they think about this Lt. Colonel, but I'm sure they love him and would certainly like his lawyer's views on homosexuality.

5. Okay, I'm confused
If the guy is so smart, how is he going to actually build a case? Obama is president, FACT. Obama has a birth certificate, FACT. He has a passport, FACT. What else will the court consider? I don't know if he's noticed or not, but Obama has smart lawyers too.

It's moot. It will not and cannot come up.

Want to know what this is REALLY about for the attorney et. al.?

$500,000.

They're bilking the birthers out of half a million and Lakin is a dupe.

What's more is, they are violating tax law by claiming the donations are tax deductible.

15. I largely agree with you but not about tax law.
You write that "they are violating tax law by claiming the donations are tax deductible." My understanding is that support for litigation is a permissible purpose of a 501(c)(3) organization. Assuming that they've properly established such an entity, it can spend money on litigation and the deluded contributors can properly take a deduction.

Of course, they're still being bilked, for the reasons you state.

7. Courts martial are NOT like civilian courts - they will not let him grandstand as he could

in a civilian court, and his actions MAY prejudice the judges, who are not very fond of civilian lawyers - there is no real jury, just senior officers who decide the case then and there.

I think these people are in for a real shock...

14. He is almost certainly going to lose all his military pensions and benefits-
He has over 18 years in the Army - and will be in prison for some time as well, probably in the US Disciplinary Barracks in Leavenworth, KS. It is a much better place than it once was, but still no day at the beach...

2. Hook a true believer to fall for it.

3. Collect donations from lemmings.

It's a pretty good game, unless you get charged with conspiracy to induce insubordination in the military. In that event, you go to jail.

12. No, but the JAG may refer to the DoJ if there is evidence of this:

18 USC § 2388. Activities affecting armed forces during war

(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or

Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so—

Shall be fined under this title or imprisoned not more than twenty years, or both.

(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).

(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.

Among other things, Lakin's laptop computer was seized when his Pentagon access was denied. That computer may contain evidence of a seditious conspiracy with certain civilians.
