Especially after I get married. My GF is a Chinese national. If some TPD officer demands to see her birth certificate with me there, there will be open warfare.

Remember, Dupink is the PCSO. . .TPD is not under the PCSO. Chief Miranda may enforce this law, since he is a political flag.

6. I'd be very careful about doing that, Az has huge corruption problems
in their law enforcement.

7. If she's a Chinese national, isn't she required to carry her paperwork anywhere in the US?
If you are not a citizen of the US, you are required to carry your documents with you at all times by federal law (nothing to do with Arizona law).

Do you usually have interactions with the police when you visit your brother?

13. Not only that, but it could get her deported.
Even legal noncitizen residents can be deported if they're arrested and the government decides that they're "criminals". One of the requirements for holding a legal visa is that you must obey all laws and avoid all arrests and convictions. Failure to do so is grounds for immediate visa termination.

About four years ago a friend of my brothers (and a CANADIAN, no less) was having a beer in a park with his girlfriend and her son. Someone called the police on him (it's completely illegal in my community to consume alcohol in a park, and carries a steep fine), and he ended up arguing with the officers over it. He was perfectly sober and was willing to chuck the beer, but had no idea about the law and thought he should get off with only a warning. They demanded that he take a breathalyzer, and he refused (he was sober, but didn't think that you should be breathalyzed for drinking in a park). That got him cuffed and taken downtown for a 6 hour visit to the city jail. He was released without charge, and later paid his fine, but the real punishment came in a letter a couple of months later, informing him that his visa was being revoked for criminal activity. They wanted to send him back to Canada! Because he had a beer in a park! Because he argued with the officers about their draconian enforcement!

He fought it, and the judge ended up rejecting the deportation, but hiring the lawyer cost him a large amount of money that he really couldn't spare. He was also told that the incident would reflect very poorly if he ever decided to pursue citizenship (he was here on a student visa, and didn't have plans to permanently immigrate anyway).

Arguing with the police in the presence of a visa holding friend is a terrible idea, because her arrest could have serious consequences.

8. Tucson cop files suit challenging immigration law
http://azstarnet.com/news/state-and-regional/article_0d3a509c-9fb9-58c7-89cf-47db9f240bd9.html

A Tucson police officer has filed a federal lawsuit challenging Arizona's new
immigration law, claiming the legislation will hinder police investigations in
Hispanic-prevalent areas.

The suit, filed Thursday in U.S. District Court in Tucson by Officer
Martin H. Escobar, also claims SB 1070 would make police focus more on
immigration than helping people in need.

"What are we saying to the undocumented who are victims of crimes,
what are we saying to the undocumented who are critical witnesses to crimes?"
said Escobar's attorney, Richard Martinez.

The suit also claims that the new law, which Gov. Jan Brewer signed on April 23,
violates several constitutional rights and also violates federal law because the
Tucson Police Department and the city have no authority to perform immigration duties.

P.s.Chief of Police in Tucson is Roberto Villaseñor.

9. There is no requirement in the new law to show a birth certificate
Edited on Fri Apr-30-10 11:33 AM by slackmaster
Please stop repeating that canard.

My GF is a Chinese national.

I presume she has a passport and a valid visitor's visa. A TPD officer probably couldn't read a Chinese birth certificate anyway.

10. oh cheeseandrice...
An Arizona policeman is not hiding behind every bush and street sign justing waiting to harrass you or anyone.
But if you want to pick a fight with a police officer I'm sure one will take you up on it in ANY state.
