Something is bothering me |

I live across from a public school. It is adjacent to a Salvation Army church. Several years ago the PS wanted to lease a spot on their property to build a cell tower. The neighbor hood raised a stink and eventually they put up a tower disguised as a tree, pretty good actually. Just about that time the SA completed their big , new , ugly church, they soon added a bigger, unadorned cell tower that is visible for blocks, with no public comment or protest, which I find hard to believe.This is a tax free church and they are apparently leasing out property. That sounds like commerce to me, not religion.I am ready to start shit, but am unsure of their tax liability any advice?

Nearly every city, town, borough and township has zoning laws. I suggest taking a look at what's on your books. A church like any other property owner has to abide by zoning laws. Most zoning regs mandate public hearings when changes to property are being made. Also many regs prohibit structures above certain heights. They also mandate what can and cannot be in certain districts.

I also know the school was approved partially cause they needed cash, so the SA must be being paid. Next time I'm near city hall, I'll check

can engage in any legal activity - assuming their articles of incorporation and bylaws permit it.
Any IRS recognized tax-exempt organization is only exempted from paying taxes on revenues that originate from not for profit purposes. Other activities remain fully taxable.
Even though that Salvation Army church is recognized as a non-profit organization they should be paying unrelated business income tax on the lease of that property.
