Steele says Kagan endorses 'the liberal agenda'
RNC Chairman Michael Steele took a shot at President Obama's new Supreme Court nominee today, saying Solicitor General Elena Kagan has endorsed "the liberal agenda."

Steele cited Kagan's efforts as Dean of Harvard Law School to bar military recruiters from campus out of opposition to "Don't ask, don't tell." (Kagan relented when the Supreme Court upheld a law cutting off federal funds from schools that did not allow recruiters on campus.)

The RNC is also calling attention to a 1993 law review article Kagan wrote memorializing former Supreme Court Justice Thurgood Marshall, in which Kagan quoted from a speech in which Marshall said the Constitution as originally drafted was "defective."

"Given Kagan’s opposition to allowing military recruiters access to her law school’s campus, her endorsement of the liberal agenda and her support for statements suggesting that the Constitution 'as originally drafted and conceived, was 'defective,'" you can expect Senate Republicans to respectfully raise serious and tough questions to ensure the American people can thoroughly and thoughtfully examine Kagan’s qualifications and legal philosophy before she is confirmed to a lifetime appointment," Steele said in a statement.

1. That doesn't matter. She's no good because Obama picked her. So says Cenk.
And she's a blank slate. So says Greenwald.

And she's not as pretty as Jane Hamsher.

6. Hot darn....he got it right she should be liberal
What do the republicans think ONLY far right wing nut cases like Scalia, Thomas, Roberts and Alitio should be appointed.
This country got screwed up royally by having them on the court. If they weren't we wouldn't have had Bush for eight years. And the country wouldn't be the damn mess it is in, that this administration is trying to fix.

7. That's part of the amazing hypocrisy of the Republicans
they appoint far right out of touch judges and think nothing of it. Yet when it's a Democrat in office suddenly anyone not dead center or to the right of center is unacceptable.

8. Michael Steele supports slavery!
The RNC is also calling attention to a 1993 law review article Kagan wrote memorializing former Supreme Court Justice Thurgood Marshall, in which Kagan quoted from a speech in which Marshall said the Constitution as originally drafted was "defective."

Dumbest Republican argument ever.

They support the Constitution "as written"? Let's hear them defend that!

15. The GOOP Playbook...
Is gonna be nasty on this. They gave in too easily for Sotomayor and have taken a hit on HIR and now on Wall Street Casino reform...they need a "stop"...something to show us they are "relevant" and try to keep their base energized going into the election.

Kagan proves a very nice diversion from the various blistering and divisive primaries going on and dragging her confirmation into the summer would put it past many of the "worst" of the primaries and be used to rally the tea baggers and fundies and other racist, homophobic and sexist elements of the right wing.

This "she's too liberal" is the opening salvo...almost knee-jerk to start the game rolling. Once the "afterglow" of the nomination subsides, watch for the cherry picked statements and dogwhistles to start really rolling. We'll find out she hung out smoking pot with Bill Ayers in ACORN headquarters or once dissed a white guy and got him all bent out of shape. Sadly I also expect "teh gay" dogwhistle to start blowing here. I've been hearing it already. The "liberal" is the first step, then the questions about her personal life and the "some say" stuff that is sure to be astroturfed to distract and delay.

This isn't about Kagan, it's about power...but then these things always are.
