Defiant Fresno pot-shop owner out of jail

The owner of a Fresno medical-marijuana clinic is free from jail today, a day after he was arrested and ordered to spend 15 days in jail for violating a court order that prohibits him from selling the drug.

Rick Morse, 48, said authorities released him at 5:15 p.m. Friday. He said he's not sure why he was sent home, but he is relieved.

Jail officials said today that Morse was released because of overcrowding at the jail.

“I was prepared to be go to jail for 15 days,” said Morse, operator of Medmar Clinic. “It was quite a shock and they did not tell me why. Right now, I am just blissful.” Earlier Friday, Morse had told Judge Donald Franson Jr. he had no legal authority to throw him in jail.

But Franson ruled that Morse had violated a court order when he admitted in court Friday that his Medmar Clinic in the Tower District still sells marijuana to patients.
