Chick-fil-A cries fowl over Eat More Produce


Troy Gage's fruit and vegetable market in Winter Park is playing a game of chicken with one of the nation's most popular fast-food chains.

Chick-fil-A has a beef with Gage over his shop's name, the Eat More Produce Farm Market.

Chick-fil-A says it sounds too much like "Eat Mor Chikin," its longtime advertising campaign, featuring cows trying to save their skins by urging diners to forgo burgers in favor of chicken sandwiches.

Gage has received two letters from a law firm representing Chick-fil-A telling him to stop using the name.

"You are playing off of and imitating Chick-fil-A's valuable Eat Mor Chickin Intellectual Property," said one letter from Anne Yates, an attorney for Adorno & Yoss. She did not return a call or e-mail seeking comment.

The letter also suggests he use "Eat Produce" instead.

12. I don't ask them to open on Sunday -- I say to close them on Monday through Saturday.
As well as being closed on Sunday.

4. Eat more produce isn't much bigger than a roadside veggie stand
it's one small building with an outdoor area that acts as a nursery. It's been there for a while and it's right across the street from Chick-fil-a (the very unChristian Right Wing owned crap food peddler). Locally grown organic and hydroponically grown fruits and veggies are WAY cheaper at Eat More Produce than they are at any other grocer in the area, so I hope that the crap food peddler doesn't drive them out of business with their frivolous lawsuit. Hell, it's not "Eat Mor Produs". They have no case.

6. The idea that fast food chains (or anyone else) can trademark common language is ridiculous
The shit these companies are trying to pull is beyond the pale. Are they really trying to bully a small company into believing they have exclusive rights to Eat More (anything)?

The worst part is that if the Eat More Produce Farm Market doesn't "cease and desist" that they probably will face a lawsuit that will be a drop in the bucket for Chick-fil-A but a serious financial threat in terms of lawyer/court costs for a small company.

11. A cease-and-desist can be waved away by an aggressive lawyer for the defense
Happened with an organization I was associated with a few years ago. Our attorney told the law firm issuing the C&D to "pound sand," which they subsequently did.

a little mom-and-pop business isn't going to have a staff attorney to tell the bully-boy corporate attorney to go pound sand. Thats more the point, and I suspect chick-fil-a knows this. Much like Subway threatening a few small buisnesses with litigation if they didn't stop using the term "footlong."

how can anyone say they have the right to a certain phrase even when the wording is different?
