The National Immigration Law Center is the lead litigator suing to overturn Arizona’s immigration enforcement law on grounds that it’s unconstitutional. SEIU is one of several plaintiff organizations backing the suit. Ghazal Tajmiri of the National Immigration Law Center says protecting America’s constitution and its rights while preventing any state from trumping the federal government on immigration issues are among the legal objections to this law.
: “It delves into immigration law which is strictly federal grounds and it’s pre-empted basically by the supremacy clause of the U.S. constitution because under the U.S. constitution only the federal government and Congress is allowed to enforce immigration priorities, pass immigration laws and apply them. However this law is attempting to do that in a state.”
Tajmiri says the Arizona immigration law isn’t limited to affecting those who are undocumented in the U.S.
: “One of our main plaintiffs actually is Mr. Jim Shee who is a U.S. citizen. He was born in Arizona. And he is of Chinese and Spanish descent. And in the past month since the passing of the statute he has actually already been stopped twice by police under pretextual reasons. And when the police stopped him they asked him for quote, his papers. So it’s not at all that, you know, it only affects people who are undocumented or who are here illegally but it affects anyone who looks like they may be not from the U.S.”
