Pressure Growing On Cuccinelli To Return Apparent Scamster's Dough
Zachary Roth | May 21, 2010, 6:08PM
... The second largest individual contributor to Cuccinelli's campaign for Virginia attorney general last year was Bobby Thompson, a Florida man who is the founder of the U.S. Navy Veterans Association, and who donated $55,500 to Cuccinelli.
A lengthy investigative report in the St. Petersburg Times raised numerous red flags about USNVA. For example, the paper could not confirm the existence of 84 out of 85 listed officers for the group. The only one they could find was Thompson, who moved out of his Tampa bungalow, leaving no forwarding address, soon after being questioned contacted by reporters. The group is now under investigation in three states ... http://tpmmuckraker.talkingpointsmemo.com/2010/05/pressure_growing_on_cuccinelli_to_return_apparent.php

... in papers filed late today, lawyers with the U.S. Department of Justice wrote, "a state cannot manufacture its own standing to challenge a federal law by the simple expedient of passing a statute purporting to nullify it. Otherwise, a state could import almost any political or policy dispute into federal court by enacting its side of the argument into state law." The section of the law Virginia is challenging applies to individuals, not the commonwealth. Because Virginia itself has not sustained an injury nor is about to, "it does not have standing to sue" ... http://www2.timesdispatch.com/rtd/news/state_regional/state_regional_govtpolitics/article/CUCCGAT24_20100524-194601/346608/

Virginia attorney general to colleges: End gay protections
Attorney General Ken Cuccinelli II says that only the General Assembly can extend legal protections.
By Rosalind S. Helderman
Washington Post Staff Writer

... In his most aggressive initiative on conservative social issues since taking office in January, Cuccinelli (R) wrote in the letter sent Thursday that only the General Assembly can extend legal protections to gay state employees, students and others -- a move the legislature has repeatedly declined to take as recently as this week ... "It is my advice that the law and public policy of the Commonwealth of Virginia prohibit a college or university from including 'sexual orientation,' 'gender identity,' 'gender expression,' or like classification as a protected class within its non-discrimination policy absent specific authorization from the General Assembly," he wrote in the letter ...

Nature rains on Cuccinelli: “The University of Virginia should fight a witch-hunt by the state’s attorney general.”
Physics Today slams "blatantly political move"; State Senator labels it "ludicrous and frivolous."
... The prestigious science journal Nature has a must-read editorial ... On 23 April, Cuccinelli filed what amounts to a subpoena ordering the University of Virginia to hand over, by 26 July, all available documents, computer code and data relating to Mann’s research on the five grants. He also demanded all correspondence, including e-mails — from 1999 to the present — between Mann, now at Pennsylvania State University in University Park, and dozens of climate scientists worldwide, as well as some climate sceptics. The order stated that Cuccinelli was investigating Mann’s possible violation of the 2002 Virginia Fraud Against Taxpayers Act — although no evidence of wrongdoing was given to explain invoking the law, which is intended to prosecute individuals who make false claims in order to access government funds ... Mann’s research has been upheld by the US National Academy of Sciences, and an investigation by Pennsylvania State University into the e-mails also cleared Mann of any misconduct. Given the lack of any evidence of wrongdoing, it’s hard to see Cuccinelli’s subpoena — and similar threats of legal action against climate scientists in a February report by climate-change denier Senator James Inhofe (Republican, Oklahoma) — as anything more than an idealogically motivated inquisition that harasses and intimidates climate scientists ... http://climateprogress.org/2010/05/12/cuccinelli-witch-hunt-nature-mann/
