You were right, I was wrong. This AZ border law is cruel, not helpful.
I don't know what to say except I was wrong. You were right. The new legislation in my state, AZ, might aspire to be positive, but it is ultimately cruel, unworkable and the total anti-thesis to what we need right now.

Thank you DU for waking me up.

1. Mike 03 it happens and that's why DU is such a cool resource
The real scary thing is Brewer and her ilk have no idea of the havoc they brought upon the state of Arizona. It's going to take a Mexican American citizen getting hurt or killed for some bullshit before others understand what the deal is. When this happens I hope the victims family sues AZ and Brewer for their last penny. Sorry but they only undertand losing money.

"Tension surrounding the passage of Arizona's tough new law cracking down on illegal immigration contributed to the slaying of an Hispanic man, allegedly shot by a white neighbor, a representative of the dead man's family said Friday. Police and the family said the arrested man, 50-year-old Gary Thomas Kelley, allegedly directed racial slurs at 44-year-old Juan Daniel Varela before the May 6 shooting near their homes.... ‘When you have talk that becomes aggressive, it escalates the violence,' said Carlos Galindo, a Phoenix radio commentator acting as a spokesman for Varela's relatives at a state Capitol news conference." -snip-

It's a mean-spirited attack on an entire community for GOP political posturing.

4. Since federal immigration uses the same reasonable suspicion
standard that is in the AZ law, how does the federal government do it without profiling?

9. I can't find the article where I read it, but
ICE agents act (with a warrant) to raid and arrest. So those who have to prove their status are under arrest or were rounded up in an ICE raid with a warrant. Arizona's law says that the officer can demand proof of status without a warrant and without actually making an arrest.

my friend in Tucson was canvassing in South Tucson and he's got dark skin.

the border patrol stopped him frequently.

me, i walked across the border at Nogales without slowing down.

14. There is case law that says Fed'l Border Patrol Agents can use racial profiling, to a limited extent
But the 9th Circuit Court held that racial profiling by state and local police departments in San Diego was unconstitutional because of the large number of ethnic minorities who live in the area. http://caselaw.lp.findlaw.com/scripts/getcase.pl?navby=search&case=/data2/circs/9th/9750643v2.html

Perhaps it's true that the older we get, the less certain and self-righteous we are in our opinions. I find myself being influenced all the time by the information and views presented here at DU. Perhaps not as dramatically as you, in this case--YET. But when I am compelled or persuaded to make such a radical change in my views, I hope I will remember your honesty and courage and be big enough to follow your example.

You're a good man, Mike 03. Of course, we already knew that from witnessing your participation here--you've just validated it, once again.

15. My Filipino co-worker
Won't be going to Arizona anytime soon. He's brown, he has an accent and he's worried. If he were stopped, his citizenship theoretically wouldn't be an issue, since he's a citizen. But his accent and his skin color quite likely could be to the people who will use this law as a legal exercise in racism.
