"None of the factors the court weighs in considering a
motion to stay favors granting a stay. Accordingly, proponents’
motion for a stay is DENIED. Doc #705. The clerk is DIRECTED to
enter judgment forthwith. That judgment shall be STAYED until
August 18, 2010 at 5 PM PDT at which time defendants and all
persons under their control or supervision shall cease to apply or
enforce Proposition 8."

1. I'm unhappy. I see no conceivable justification for waiting until Aug 18 to lift the stay.

2. Brilliant! And the judge doubts that the pro-8 people even have standing to appeal the decision.
That includes this: "Proponents also point to harm resulting from “a cloud of uncertainty” surrounding the validity of marriages performed after judgment is entered but before proponents’ appeal is resolved. Doc #705 at 10. Proponents have not, however, alleged that any of them seek to wed a same-sex spouse."

3. hahaha...that WAS a slapdown
omg...marriage as an individual right? Nothing could put the wingnut undies in a twist faster than being reminded they aren't the only Americans with constitutional rights.

I suspect there is going to be quite a public whining and gnashing from the homophobes, who believe they always have "standing" simply because...well, God said they were appointed to run everyone's lives. . .but since the state officials are NOT going to appeal the decision, it is hard for me to believe the defendant-intervenors (Protect Marriage.com) has much standing to file an appeal.
