This is my recollection of something I read at the FReakshow a while back. The terms of Bush and Cheney expired at noon on January 20, 2009, so they have no more status. Obama isn't President because he's ineligible, under the Constitution, and Biden is disqualified sort of derivatively -- he was named as Vice President by electors who were pledged to the Kenyan and who therefore were elected improperly.

The Presidential Succession Act provides for this situation, where neither a President nor a Vice President is able to serve. The Act says that the order of succession is: Speaker of the House, then President Pro Tem of the Senate, then Secretary of State. BUT the provisions that include the two legislative leaders in the succession to head the executive branch are unconstitutional under separation of powers.

Therefore, as of January 20, Rice became President. That Hillary Clinton is now in Rice's old office doesn't change that, because neither Clinton nor anyone else has succeeded Rice; Obama, being ineligible to be President, had no authority to appoint Clinton, and that supposed appointment, like all his other actions in office, is null and void.

In the face of careful reasoning like that, you'd have to be a real idiot to think that Cheney is President.
