CA Appeals Court Rejects Prop 8 supporters
attempt to force Scwartzenegger and Brown to defend Prop 8. This was just another attempt to establish standing and it's good to see it was shot down so quickly. This is a California Appeals Court but still it further advances the case that outside groups have no standing to sue.

2. So the case won't be heard by the 9th circuit?

3. No, it will be heard
but this was another attempt to establish standing. The Federal case will still happen, but this is still another loss for the H8ers and that is worth mentioning.

4. No question!
I am not in the legal profession, so tend to get lost on a lot of nuances that most people understand right off. Like rulings on individual motions. :o

I know I am rolling the dice with my desires, but I would like this to go to SCOTUS and be settled once and for all. It is my understanding that the District Judge wrote his opinion in such a way that many experts think there is no way Kennedy can rule against him by using Kennedy's own rulings/opinions in the justification.

5. Yes. And I'd like to point out that the current
chief justice himself, when he was a trial lawyer, worked with the individuals who were fighting Colorado's Amendment 2 in the early to late 90's.

Both the ruling striking down Amendment 2 AND Lawrence V. Texas (sodomy laws) were written by Kennedy.

So I'm pretty optimistic about our chances.

It's a weird feeling. :-/
