What is “States’ Rights”?
In Missouri, Proposition C passed. Part of the language in the ballot initiative, which passed with 71 percent of the vote, went like this:

“Shall the Missouri Statutes be amended to….Deny the government authority to penalize citizens for refusing to purchase private health insurance or infringe upon the right to offer or accept direct payment for lawful healthcare services?”

With this, as well as the striking down of Arizona’s controversial SB 1070 by a federal judge, The Political Panorama decided to look at the concept of states’ rights this week.

They actually mean something, believe it or not. The oft-repeated and always-incorrect assertion that the commerce or general welfare clauses authorize the federal government to do whatever it likes on any topic that may interest it would make the rest of the Constitution meaningless if it were true.

One recent judicial decision struck right at the heart of commerce clause abuse, noting that the government may not draft an unwilling individual into commerce in order that it may regulate him. All you have to do is consider what the next corporate-owned government might do were such things not barred to the feds.

POWERS that haven't been granted to the federal government belong to the states.

All RIGHTS belong to the people.

6. Might as well as voted for smoke because
the Federal government has the final say. States can pass laws but they can't interfer with a Federal Law. The Health Care Bill is federal.

11. It's been a part of the history of the United States
At various times in our history, the pendulum would swing back and forth on what powers the Federal government has, and what powers are reserved to the states.

I disagree with those who think that it's just about racism or secession. We're about to see a SCOTUS decision confirming that Massachusetts has the right to define marriage any way it wants to, and that DOMA is unconstitutional as to whether same-gender MA couples can be treated as married for Federal purposes.
