Former Gaston County District Attorney Michael Lands said he didn't know about voter fraud allegations involving the 2004 campaign of U.S. Rep. Patrick McHenry until last fall when he read on the Internet that he was being accused of quashing the case.
"There was some Web site that claimed the state Board of Elections had brought the case and reviewed it, and that I hadn't pursued it," said Lands, the former Gaston County prosecutor who is now a district judge. "I said, `What are they talking about? There's no truth to that.' "
Now the case is in the public spotlight. Last week, a grand jury indicted a former McHenry aide because of questions about whether he had legal residence in North Carolina when he registered to vote and cast a ballot in his boss' primary election.
Lands said he called the state elections board and inquired about it, and asked that all of the information in the case be forwarded to him.
Don Wright, general counsel of the N.C. elections board, confirmed that the case wasn't forwarded to the district attorney's office until November 2006 because a formal challenge hadn't been filed in the matter.
Wright said that in late July 2004, Donnie Young of Hickory asked the board about the voting eligibility of Michael "Aaron" Lay, a Tennessee native who was working on the campaign of McHenry, the Cherryville Republican who won a GOP runoff to get elected to Congress.
Lay, who lived with McHenry and other campaign workers in McHenry's house and registered to vote at that address, was indicted a week ago by a Gaston County grand jury on two counts of election fraud. He still hadn't been served with the warrant, his attorney, Thomas Goolsby, said Monday.
Lay said Monday that everything he knows about the indictment has been from what he's read or heard on the news.
"As far as I know, from the media reports, I have been indicted," he said, "(but) I have not been contacted by the DA's office."

McHenry has said that he thinks the case is motivated by his political enemies.
But Bell, also a Republican, denied that there was bad blood with McHenry, and said he contributed money and helped host a fundraiser for the congressman.
"Patrick still owes me a steak dinner" from an Election Day bet they made in 2006, he said.
Bell, who said he's preparing for an upcoming case and would handle Lay's case afterward, would not say if he plans to seek indictments against any other McHenry campaign workers.
Dennis Benfield of Hudson, who worked on the campaign of McHenry's opponent, David Huffman, said he objects to the way McHenry was elected.
"People voted illegally and canceled out my vote, which was cast legally," Benfield said. ....(more)
