You might as well claim making a fire is arson.
They aren't torching a library, someone's property, a structure, or to my knowledge seeking to scam their insurance.
I'm offended by the dangerous stupidity as well but you simply cannot twist this into a crime to stop the offense or punish those who disturb your sensibilities.

You just can start fires whenever you want. You can start them for grilling and such but you can't just start fire.
I spoke with someone from the Gainesville police and she did say not to come because they expect so many protesters that you would just sit in a traffic jam but she did say, "Well they don't have a permit" as that was the answer.
