The Ninth Circuit Court of Appeals handed George W. Bush, Dick Cheney and Barack Obama a major legal victory. The court upheld the argument advanced by Obama's Department of Justice that Bush's rendition program - used to send victims to be tortured - involves "state secrets" and its legality, therefore, cannot be adjudicated by courts.

On Sept. 8, the New York Times responded with a scathing editorial: "Torture is a Crime, Not a Secret."

Torture is a crime. Some have argued, offhandedly, that it can also save American lives. If our laws against torture need changing to provide more "security" for our people, then let's change them. If we cannot or will not change our laws against torture, let's make sure everybody - from the president of the United States on down - obeys them.
