WASHINGTON — President Barack Obama's decision to appoint Harvard Law School professor Elizabeth Warren on Friday to oversee the creation of the new Bureau of Consumer Financial Protection cheered consumer advocates and Democrats Thursday, while dismaying Republicans and business groups.

To avoid that, Obama chose to make her an assistant to the president and special adviser to Treasury Secretary Timothy Geithner, a staff position that doesn't require Senate confirmation. The White House will announce her appointment on Friday, an administration official told McClatchy on condition of anonymity because the announcement's not yet public.

Even without being named the bureau's director, Warren's expected to wield broad power — hiring the staff and setting the mission. Once she's got the bureau up and running, Obama can appoint a formal director, to whom Warren could pass the baton of leadership, the administration official said.

Ok, now assuming THIS report is true, and I actually believe this is more accurate since I trust McClatchy's reporting more than other sources, I will eat crow. I was semantically wrong. Warren will not be TECHNICALLY Interim Director. There you have it. I will be wrong if THIS report is true, which I suspect it is.

However, there IS also this report, which I suspect is merely bad reporting, that may have lead me to the erroneous conclusion she WOULD be Director. But leave it to Obama to fuck me and find a third, BETTER way of doing this thing:

"By appointing Warren to a post within the administration - much as the White House did with "car czar" Steven Rattner and "compensation czar" Kenneth Feinberg - Obama would free her to act as the bureau's director beginning immediately while avoiding a confirmation battle. The move also will thrill the consumer groups, labor unions, academics and liberal lawmakers that have lobbied relentlessly for her to lead the new regulator."

So there you have it. When the announcement is made and it's official, I suspect that I shall be eating a big fucking helping of crow.

It would be filled for a year and then, if congress was still being idiotic about it he could easily reinstall her with another recess appointment. There is nothing illegal about doing it. It would be strange and it might make people nervous about the precedent, but it wouldn't be illegal and the position would be filled.

There is Nothing in the constitution that forbids refilling the vacant slot with a recess appointment. Nothing. I have read it a dozen times and while strange there is nothing technically preventing it.

That's what prevents someone doing what you're suggesting. The recess appointment MUST go through the confirmation process at the end of the recess term OR someone else. You think John Bolton would just willingly leave his position if he could've just been re-recessed when his term was up? Think about it, it's a silly notion. No one's ever done what you say because they CAN'T.

You understand what the word "must" means I assume.

If an admin. tried to pull what you suggest it would be quickly ruled against in the first court that had to rule on it. It's just downright silly.

This is the constitution

"...and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session"


See, you (and wikipedia) sort of added some language about forcing the appointment to stand up to the senate when actually there is no such language. Of course it is implied to some degree but technically it can be circumvented. Aside from all that why not think of the good that a year of reorganization and retasking that an appointee can accomplish. And after all that (and a good PR run) how good do you think the repukes will look playing their obstructionist nonsense again.

From a political standpoint making the obstruction and blockage the story is advantageous, especially if it looks like there is no legitimate reason for it. It is what we have failed to do so far.

As to the rest of your post, I was merely pointing out how ironic it seemed that you would use the iconic image of Che to front what felt like a loyalist, moderate, Democratic position, while citing Safire. It was ironic and remains Ironic.

Afterwhich you accused me of pretzel logic... somehow. And to simplify my response I will merely say "Which part?"

I'm not trying to twist out of anything. It is strange. It is ironic (whether intentional on your part or not). It is what it is. Unless you saw some parallel future where I did actually try to twist out of calling it ironic or strange and presciently threw up a pretzel in preperation I don't know what the hell you are talking about.
