1. I believe its a 'temporary' decision,
so the case will have to be fully litigated, not appealed. SO ALL THE FACTS will come out, and make the judge's decision even more solid.

5. The judge first ruled against her. The Court of Appeals told him to hold a trial...
to see if the discharge of this particular soldier was justified. The judge conducted a two week trial, at the end of which he ruled in favor of the nurse.

So,at the District Court level, this has been fully litigated.
