1. There's been no document produced so far, but one or more from the SSA is supposed to exist.
http://www.cnn.com/2010/POLITICS/09/29/whitman.allegations/index.html?hpt=Sbin

Allred alleged that Whitman should have known Santillan was an undocumented worker, because several letters, dating back to 2002, were sent to her about the maid's "mismatched" Social Security number.

A copy of that letter will be released to the news media Thursday, Allred said.

10. the only way Allred would have the document (stolen?)
Edited on Thu Sep-30-10 10:19 AM by karnac
is if DIAZ was intercepting the mail from whtman and retained a copy. how else would they have a copy?

could backfire.

It's a given btw. the SSA would have HAD to try to mail whitman. that ALWAYS happens.

18. Doesn't it have to be thrown outside the house before it can legally be taken?
Edited on Thu Sep-30-10 10:33 AM by dkf
Otherwise it is theft right?

This housekeeper seems to be incriminating herself in numerous ways. What types of protection does she have from prosecution? Whistleblower laws? Or just goodwill?

20. I don't know the laws regarding mail in the trash
Edited on Thu Sep-30-10 10:35 AM by tammywammy
But she could have seen something with her name on it and been curious, that would explain why someone would get it out of the trash. I mean, if I saw something at my employer's with my name on it, I'd look at it, and I'd sure as heck keep it if it was something along the lines of a letter from the SSA asking for information (or something similar).

edited to add: Also, it shouldn't have been thrown away period. A good employer would add any correspondence to the employee's personnel file for future reference.

2. According to Ms. Allred and Ms. Diaz, yes
Here is the press conference from Ms. Allred's YouTube channel:

http://www.youtube.com/watch?v=1iP4B8otO50

As well, George Stephanopoulos http://blogs.abcnews.com/george/2010/09/gloria-allred-i-have-the-letter-proving-meg-whitman-is-lying.html">blogs today:

Allred: I Have the Letter Proving Whitman Is Lying

September 30, 2010 8:27 AM

Gloria Allred told me on "GMA" that she will produce evidence today that proves Meg Whitman was lying when she denied knowing that her longtime housekeeper was an undocumented worker. It’s a 2003 letter to California’s Republican candidate for governor from the Social Security Administration, asking her to explain why her housekeeper’s social security number didn’t match the name on file.

“We are going to produce today and what this shows is total hypocrisy on part that she is denying that she received it,” Allred told me. “Because she knows that shows that that was a tip-off to her and her husband that she was employing an undocumented worker.”

11. Can you simply request a copy or is this proof that the maid had the copy?
Also is it normal for maids to be reading through their employer's correspondance?

12. I totally can't supply a link, but
Edited on Thu Sep-30-10 10:28 AM by blogslut
...in one of the zillion articles I read, I believe Ms. Diaz claims she fished the letter out of the Whitman's trash can.

EDIT ADD: Here ya go:

"Nicky also alleges that for several more years, Ms. Whitman continued to receive letters from the Social Security Administration office regarding the mismatch in the Social Security numbers,'' Allred said. "She alleges that she saw these letters after they were thrown in the trash.''

link: http://www.mercurynews.com/california-governors-race-2010/ci_16205474?nclick_check=1

EDIT EDIT: Those were subsequent letters from the IRS - according to Ms. Diaz. As per Allred & Diaz, the Whitmans confronted their maid with the original IRS query and told her to "check on this".

15. Well if they have the original maybe they can get some fingerprints off it.
That would put this to rest.

24. According to this asking the employee to fix it is the proper procedure.
www.immigrationsolution.net/employer_compliance_worksite_enforcement_page3.php

You are not allowed to assume the person is here illegally as that is against anti-discrimination laws. The employee can attest that the information is correct and if signed on that is the end of the employers obligations.

4. Whitman's camp is claiming that the housekeeper/nanny intercepted the mail.
She had plenty of time to watch for the mail between housekeeping and nanny duties in that 15 hours per week that she was at the house.:sarcasm:

7. So what? Isn't Ms. Whitman's position that the employers are responsible for checking out the
people they hire?

9. They also claim that they did check documents as required.
TMZ.com posted the Whitman team's response with copies of documents.

See? After all, she's a wealthy Republican. Nothing is ever her fault.

23. I'm sure her lawyers have an explanation for that.
Not necessarily the truth but a lawyerly explanation.

Either way, Whitman was already losing ground to Brown before the Allred news conference.

For me the telling part of the story is that if Whitman was fooled by her employee, it would have made more sense politically to bring it up in the context of explaining her position on employer responsibility in checking documentation rather than ignore her own experience. She can't be so naive as to think the story wouldn't see the light of day. Whitman made a lot of enemies while at eBay.

25. She said she was trying to not plaster Diaz's situation all over the papers.
The woman can still be deported after all and if she was still using her forged papers she would be unemployable.
