The SS# may be good. In fact, I'd bet you most of the employees that aren't legal still have good SS#'s, they just simply aren't attached to that name. But an employer doesn't know that (duh, of course or you would have everyone and their brother stealing IDs left and right).
You only know whether the number is good or bad. And the immigrant community has LONG ago figured that out when they began distributing fake SS cards.
It happened to me personally. I had an employee 10 years ago who the IRS finally caught up with last year! That is not a typo - it took 10 years for that SS# to finally get flagged as being used inappropriately, and only because the real time owner of that SS# was finally retiring and discovered it himself.
By then, my guy was long gone. He was only a summer worker for me anyway. Even with e-verify, he would have come up okay. He spoke perfect english (came into the states as a child). His name was anglicized. In other words, I would have been discriminatory for NOT hiring him.
While Meg Whitman deserves everything she's getting and more, e-verify isn't the answer we want in dealing with illegal immigration and employers.
