Schumer's Had Enough

I said the other day that I didn't necessarily think that current DAG McNulty's resignation and the sneak testimony of former DAG Comey was related. Let me revise that opinion. With the perspective of a few days, I think they may well be related, if for no other reason than Schumer has simply lost patience with this charade.

Let me just explain a few details of note. First, Paul McNulty resigned while at a US Attorney's meeting in San Antonio. Gonzales was, as far as I know, back in DC preparing to blame everything on McNulty at the National Press Club. Now why would the DAG wait until he was with the 93 men and women--most of them former peers--who have been screwed over by this affair?

But then, the very next day, McNulty's friend Chuck Schumer has McNulty's predecessor come in to testify. Schumer makes a point that Comey is not subpoenaed. Why make that point? I don't know--but it might be to get around the problem he had last year when he tried to bring Comey--and Jack Goldsmith--in to testify on the NSA program(s).

At the same hearing at which Gonzales parsed wildly about which program there had been a disagreement about (in fact, immediately following that parsing), Schumer, then SJC Chair Specter, and Gonzales had a long exchange over whether SJC could call John Ashcroft, Jim Comey, and Jack Goldsmith as witnesses.

"Something is rotten in Denmark." Video on Crooks & Liars, Schumer being interviewed by Tweety. My memory may be faulty on the quote, but Schumer made it plain as the light of day that this investigation was continuing.

The failure of the media to get this is a reflection of corporate efforts to usurp professionalism that have been underway for nearly three decades now. The media and the medical profession were the first to succumb. The ascendancy of accountancy is another reflection of this trend. It is an effort to elevate actuarial and profit motive concerns above professional concerns of truth, justice and health for instance. Dean was campaigning on this theme in 2004 and this is one of the points of policy clarity that made him so threatening to the minders of the corporate media.

The legal profession has been one of the last bastions of professional independence, but the practices of the current administration with respect to the Department of Justice have intentionally targeted this independence. It is the same campaign designed to smear "trial lawyers" like Edwards, revamp the jurisidtional rules around credit engendered in the new bankruptcy bill and to limit the federal jurisdictions where class actions may originate. The corporate media is not outraged at the behaviour of Gonzales and Card because the corporate interest would expect the same thing from their own legal counsel irrespective of professional ethical concerns. Part and parcel to this are memes of plausible deniability, pretext and authority shell games that have devolved in defense of corporations away from accountability again in the spirit of maximizing the monterization of the society where professional goals serving individuals are sacrificed for the bottom line and the accrual of power to the executive class. It is the Enron game.

There is some glimmer of hope that there are some lawyers left, who though belatedly, are standing up against the temptation to sacrifice their duty to the rule of law for expedient positions advocated my administration principles that disregard the rule and serve merely political interests. This rings of tyranny, no? The existence of an objectivity of standard is the mark of legal professionalism. Inherent in legal professionalism is the right to make a good faith argument for a change in law or interpretation. To pursue arbitrary purposes using sophistry and disengenuous rhetorical trops of misdirection, suborning undue influence, and failing to as governmental lawyers to exercise the quasi-judicial functions of an office with stict adherence to existing standards misses the professional mark severely.

The question then is how to get the genie back in the bottle. With Democratic presidential front runners seduced by the power the executive now exercises, the courts yet engaged, and the majority in Congress slim one can only hope that the professions and the population find ways to reassert independence in the face of the tyrannical instinct now so fully gripping the imagination of our both our politicians and the media.

The ultimate risk is the slow creep toward a control economy that in many ways must motivate any push toward a "permanent majority."

which teaches law incorporating Christian thinking. For him to be exploited while ill by Bushco, has brought a painful moment
of truth to the fundies who have been 1000% loyal to Bush as a "compassionate christian." What christian concepts were at play
here, it resembles the story of the Good Samaritan, only instead of helping; it is a moment to exploit a man's weakness for
questionable ends.

13. Schumer's playing a good game of chess
For the IMPEACH! IMPEACH NOW! crowd: The vote of no confidence is very important as a first step, as Marcy has shown clearly in this article. Schumer bided his time (and blew off Specter in the process), culminating in getting Comey's testimony on record. Of course he knew what Comey was going to say; so did the Republicans. It's fascinating to watch the moves.

I want impeachment too...believe me. But I do know that if you shoot the king, you'd better kill him. This is about Gonzo, true, but it's also about Bush. It's not a house of cards suddenly falling...it's more like a fortress being disassembled brick by brick.

To any of politicians or (my bet) the media.

This kind of thing is prime fodder for the water cooler. "Did you hear what happened last night?"...

time to figure out why the US Attorney from Virginia (a battleground
state) was put on the termination list....

18. The Comey testimony provides great visual images
I have been following the news from Europe this month and my best sources of real news are DU and pod casts of Randi Rhodes programs. The Comey testimony is devastating and will have legs because the visual images of Andrew Card and Torture Boy hovering over Ashcroft in a drug induced stupor while attempting to get home to sign off on their illegal wiretapping program is quite gripping. This will ultimately be the tipping point for Gonzo.

Every time I read Marcie's writing I am more impressed.

26. Busholini, Gonzo and Card conspire to commit an Illegal Act.
Congress needs to Subpoena Ashcroft, his wife, FBI Mueller, Andrew Card and Gonzo. I believe a crime was commited in that hospital room. Also, Busholini went forward with Illegal Spying, Violating the FISA Law for several weeks. How many Felonies were commited in those weeks?
