Amendment 1 on Ga. Ballot is BAD!

Amendment 1 on Ga. Ballot is BAD!
I posted this in the Ga. forum last night, but decided to cross post it here for those Georgians who don't visit the Ga. forum.


I heard this on Thom Hartmann and about croaked! I was going to vote yes!

Heres what the amendment says on the ballot:

Shall the Constitution of Georgia be amendmended so as to make Georgia more economically competative by authorizing legislation to uphold reasonable competative agreements?

Sounds good huh? Well if you read the link you'll see that it means if you work for a hardware store, law firm, doctors office etc and they get you to sign a non-compete agreement, you wouldn't b able to work for any other business in that same field even if the working conditions, pay or anything else was unbearable! NOR would you be able to staryour own business!!!!

The guest on Thom's program said the promotion group handling this amendment is a very RW org that has already successfully gotten many amendments passed just by deceptive wording.

I & my husband have absentee bllots ans I just pulled ours down from my desk slot & marked NO to that amendment.

This amendment would not help Ga. citizens! It would deny competition to advantage the rich corps.

The link is one I found via google,, but the guest Thom was interviewing was from TPM. Even Thom said when he read it he would have voted yes!

1. Can't they ask you to sign a non-compete agreement regardless of this?
Or is that currently illegal in Georgia?

3. Yes, but AFAIK this would give them Constitutional auth.
to proscute people for breaking a non-compete.

4. Non-competes are pretty common for contracted workers
And I think it's common in certain at-will jobs too.

Frankly, in this state anything that makes it on the ballot has a high burden of proof before I will vote for it. Either that or having the Republican establishment firmly against it.

9. That sucks!
Too bad I'm not living there right now, because I would have voted Hell to the NO!!!! Competition should be free for all, that is what makes businesses viable and more open for all potential customers. That's what free enterprise is all about, right?

With GA being an at-will state, I'll be real careful about the companies I check out when I'm looking for a job. I worked for 2 companies in DC and MD who are just as at-will as the day is long. Thankfully I managed to get out when I got back in the government (which I now see was a big mistake because they're getting looney too).

Please let this amendment be defeated so I won't have to deal with this! Thanks!

Thanks for the link to my blog; I hope it was helpful.

Here's some general information dealing with non-compete clauses in Georgia under current legislation:

This amendment would shift a tremendous amount of power to corporations when dealing with employee rights.
