Whitman's ex-maid emerges as symbol
"She is becoming a national symbol," said labor leader Dolores Huerta, co-founder with Cesar Chavez of the United Farm Workers. Huerta called Diaz's actions courageous and said her story could be a catalyst for reform at the state and national levels.

Her story prompted Fox News host Bill O'Reilly to suggest that Diaz is the poster woman for millions of undocumented people who flout the law.

"What is Homeland Security and ICE going to do about her?" he demanded of the agency's chief, Janet Napolitano last week. Napolitano said she would 'seriously' look into the matter."

When Ms. Napolitano looks into this, I wonder who she will try to appease. My guess is that she'll wait till after the elections.

1. Current ICE policy is to use all of its resources to go after 'criminal' aliens.
This term is meant to indicate two groups of people

1) Aliens who are currently serving prison or jail terms

2) Aliens who are active in gang activity.

For that reason ALL repeat ALL ICE investigative personnel have been physically transferred away from the suburban and residential raids that were common under Bush.

In the San Diego sector only one non criminal undocumented worker has been taken into custody this year and the ICE officer involved was reprimanded.

getthefacts posted this OP that indicated that concerned about being in an ambiguous status that he would turn himself in for deportation. He received a letter with the following statement

“After reviewing the information you have provided, I have determined that Mr. GetTheFacts does not meet this office’s investigative priorities and therefore I must deny your request to commence removal proceedings”.

This confirms what my ICE sources have told me. You could go to the nearest ICE office and wear a shirt saying "I am an undocumented illegal alien" and they will not bother you.

There is one gray area. Sometimes ICE will investigate employers who are engaged in other illegal activity, like conspiring to specifically recruit undocumented workers or hiring underage documented workers or abusing undocumented workers. In some cases some of the workers that have been detained in those raids have been deported while others have been allowed to stay. This is a very very small number however.

This is a clear change between the Bush and Obama administration. Some people might think that there is no difference between the two administrations but law abiding undocumented aliens are not among them.

3. Thank you for the ICE information, Grantcart!
And for the link.
Hopefully, Ms. Napolitano will be "seriously" looking into Ms. Whitman's hiring practices, fine her or something, to make her the poster child for the very actions she rails against.

2. Hmm should Whitman be prosecuted for hiring illegals?
I mean that is all the republicans are preaching about. So now we should forget about the employers IF THEY ARE REPUBLICANS. Whitman better tell O'Reilly to shut the hell up.

4. Napolitano should have
referred to the ICE policy, that she will not go after the housekeeper. I hope that Whitman is investigated and at least fined, before the election.
