Please, please, please, please, please tell me Rachel didn't just quote Gibbs as wanting to rely on the SENATE to do this. The Senate, who just fell three (3) votes short and it's only going to get worse.

PLEASE give me a reason to get out of bed on election day. Mr. President you will embarrass and greatly uninspire millions if you wimp out on this.

Everything now depends on what the DOJ does.
As Rachel just said, if you leave it up to the Senate, it won't get done, not with McCain and all the other idiots.
As Rachel said to WH Officials (paraphrasing somewhat), "This is your chance. Don't just SAY you're going to do it and then NOT do it."

The Justice Department, which is an independent agency akin to the FDA, does. Obama does not control that. More to the point, the DOJ is REQUIRED to defend federal law, even if it goes against the position of the President.

... as far as possible? If the appeals court goes against them, do they have to go before the Supreme Court? From the articles, it sounds like they have a choice as to whether or not to appeal.

For instance, the President is perfectly entitled to remove his Attorney General if he so sees fit. If he wanted this ruling to not be appealed, he could stop it from being appealed.
