50. It seems that one could claim Miller's people MISUSED public property in renting it!
Or the custodian of said public property didn't properly attach conditions on how it was rented. I think if I was a taxpayer, I'd be pretty upset if a group of private individuals were allowed to "take over" public property and start assaulting those who were trying to use it. It seems that there should be some form of required language when a group "rents" something that normally is the public right of way before they can start "arresting" people.

Also, private citizens usually aren't allowed to do a "citizen's arrest" unless the other person is committing a felony. That's why shoplifting in so many states is a felony and not a misdemeanor, to allow those in stores to arrest and detain those they catch stealing stuff. For misdemeanors, in most states, a private citizen is only allowed to arrest another citizen if a police officer is present and directs him/her to do so. The cops in this case were not telling these guys to "assault" other reporters. They should all sue these thugs!

Actually, Alaska media has been all over Joe Miller since the primary which is why he's so touchy about reporters. He's hiding some big secrets about his former employment with the Alaska North Star Borough, and to the media's credit, they're trying to expose those secrets to the light of day BEFORE the election, unlike how they handled Palin in 2006.

51. They can ONLY arrest those they observe comitting a FELONY! NOT a misdemeanor!
A police officer present needs to direct them to conduct an arrest for them to be able to arrest someone legally for a misdemeanor violation or anything else that's not a felony, not the other way around.

Just a few weeks ago, NY Republican governor candidate Carl Paladino's security staff (henchmen) surrounded and physically threatened the NY Daily News reporter asking questions, at which point Paladino vowed to "take him out."

Now, another Republican candidate has his goons handcuff (handcuff!) a reporter trying to ask questions.

In both cases, when the candidate doesn't want to answer questions, he has his squad intimidate the press, then turn the situation around to suggest the reporter was "pushing" or somehow in the wrong.

I hope this reporter sues for false imprisonment.
I hope the media cares that serious reporters are being treated in this manner.

I mean, for damn near 10 years the media rolled over like puppies and piddled themselves in their excitement to be abused by the Bush cabal. Impertinent questions were "noted in the building," and nobody had the intestinal fortitude to ask substantive questions when Bush sent the military out to invade another nation that hadn't done anything to us. Cheney shot a man in the face, then retired to the dining room for the evening repast, for fuck's sake. Nobody said "boo," and the victim even apologized publicly to Cheney for taking a face full of bird shot.

With that kind of a record, why wouldn't Republican candidates expect the media chuckleheads to take more abuse than a Filipino flyweight? I'm in favor of the media actually rearing up on their hind legs and getting back at the Republicans. That hand isn't feeding you: Bite it!

It will be interesting to watch the intensity of coverage. One factor will be the Miller campaign reaction. The sensible thing for them to do is contritely walk it back. If their response is an arrogant FU, look for the story to really escalate.

They can detain someone, but as soon as the real cops show up, unless there has been a theft or a physical altercation, I cannot see how anyone gets arrested...except for maybe the persons who detained:)

Are you a Murkowski plant? True, some Republicans may turn back to Murkowski, but those who were going to, probably already have. Dems and left-leaning independents are now free to vote for the real liberal in this race. For false imprisonment,

(1) The defendant did something or said something which resulted in the plaintiff being confined; and
(2) The defendant acted with the intend to keep the plaintiff confined; and
(3) The plaintiff knew of the confinement <or was seriously harmed by the confinement>; and
(4) The plaintiff did not <consent><and/or say anything or do anything to cause the defendant reasonably to believe the plaintiff consented> to being confined.
