Court upheld School boot of Cheerleader.

H.S.'s parents sued the school, claiming her First Amendment rights had been violated. But her claim was denied by a three judge panel that decided, "in her capacity as cheerleader, H.S. served as a mouthpiece through which (the school district) could disseminate speech -- namely, support for its athletic teams

So basically students are nothing more than mindless, toys to be bend to the will of the school districts.

4. I agree with the notion that if one is a cheerleader, one has to lead cheers
so I do tend to agree with the decision, but the boy should have been banned not only from the team, but from the school. He was convicted, after all, of raping her and I think at the very least he should have to stay away from his victim. Let him attend another school, and let that school decide if it does or doesn't wish to be represented on the field of play by a rapist. But I have to say that a ruling the other way in this case would have posed a real problem for schools.

5. He was convicted of assault, not rape.
Whether an assault conviction (plea deal) with no jail time is grounds to kick a kid out of school I don't know. But if it's not, then it might not be grounds to kick him off a school sports team, either.

6. After reading the previous two posts
I had an idea, why not take an order of protection out against him. She is a cheerleader for the team he is on the team, one would have to go, so since she has the order it would make sense that he would have to stay away.
