Kevin Yoder, the Republican candidate for the 3rd District Congressional seat, is having to deal with reports that he refused to take a field sobriety test when pulled over by a Kansas Highway Patrol trooper on K-10 Highway in 2009.

LAWRENCE — Third District congressional candidate Kevin Yoder refused an officer's request during a traffic stop to participate in a Breathalyzer test to determine whether he was driving while intoxicated, according to court records obtained Saturday.

Yoder, a Republican four-term member of the Kansas House from Overland Park, was questioned by a Kansas Highway Patrol trooper in February 2009 after being pulled over for speeding on K-10 highway. Yoder declined at that time to take the breath test. The case was closed in June 2009, and records indicated he entered a plea of guilty to speeding in a Lawrence courtroom.

It is unclear from the summary document of Yoder's case in Douglas County District Court what sanctions other than fines of $165 resulted from the incident.

Existence of the case emerged less than two weeks before the Nov. 2 election for the open congressional seat in the northeast Kansas district. The district includes Johnson County and eastern Douglas County.

Ok, once I got over the wtf feelings, I had to wonder why this is just NOW being leaked to the media? Yoder is way up in the polls. The Dems have a great candidate who has run a lousy campaign. So did someone decide to start playing dirty? I am torn between thinking this is a good idea and wondering if it will backfire. What do DUers think?

1. $165? That's it?
In most of the civilized world if you refuse a breath test you are pretty much guaranteed at least the loss of your drivers license for DUI and refusing a breath test.

Besides I think this asshole would have to be one of those found with a dead girl or a live boy to even be considered in trouble for reelection isn't he? At least this might embarrass his teabaggin' ass.

Thought it was a state law?
