* Wisconsin Governor Tells His AG To Bag Lawsuit Against Reform:

Governor Jim Doyle of Wisconsin has told his state’s attorney general to forget about suing to overturn health reform, as a dozen AGs are trying to do. In a terse but scathing letter to Attorney General J.B. Van Hollen, Doyle told him his request for the state to sue is being denied.

“This law is an act of Congress, signed by the President of the United States,” Doyle wrote. “The lawsuit you suggest is a frivolous and political attempt to thwart the actions of Congress and the law of the country.”

“The State of Wisconsin will not enter into litigation intended to deny health care for tens of thousands of residents,” Doyle concluded.


He isn’t the only Governor pwnking his own AG: Governor Christine Gregoire of Washington State has also lashed out in similar terms at the state’s AG for joining the lawsuit.

2. Yeah, Jim Doyle~ I remember him
from the Primaries. There is at least one gop AG from Kentucky I believe who said he's not wasting taxpayers' money on this.

7. KY's AG is a Dem
But he was succinct in explaining why he would not pursue a lawsuit-he believed it to be a political stunt and refused to waste Kentuckians resources.

I'm in Michigan. Jennifer Granholm is my Governor. I'm waiting for her to speak up.

Your statutory authority does not, however, override the superior constitutional authority vested in the Governor to determine the position to be taken by the executive branch of the state government and certainly does not authorize you, as Attorney General, to unilaterally, and without consultation, to determine and declare the policy position of the state of Michigan.

Accordingly, pursuant to the constitutional authority vested in me as Governor, and the statutory duty imposed upon you by MCL 14.28, I am directing you to intervene in the Florida litigation on behalf of the Governor, the state of Michigan, and the Michigan Department of Community Health to uphold the recently enacted federal health care legislation and to protect and preserve the important protections afforded our state and its citizens by the new law.”"

8. Governors have the power to stop any AG lawsuit against the federal government?
Governors have the power to stop their AG from filing a lawsuit against the federal government? I didn't know that, I would have thought that AG's could spend their budget on whatever lawsuits they want.

9. That depends greatly on the state
and how their own laws and constitutions are worded. Some have more independent AGs, some AGs take their orders from the Governor, and some have to ask permission before initiating suits on matters not pertaining to state law being challenged.
