An accidental statement of the moral importance of prosecuting Bush administration figures

Listening to news radio. They do a story about expanded legal approaches to bullying.

A guy in the story says:
"It is time to call this what it is. We shouldn't call it bullying, we should call it torture because it is torture. And if we prosecute adults for torture then why shouldn't we prosecute kids for the same thing."
Everyone who just read that had the same thought... Are we prosecuting adults for torture? When did that start?

Without meaning to do so the commenter spoke volumes about the moral weight of precedent and the implied moral weightlessness of lack of precedent.
