Hypothetical: What if the SCOTUS choice was between Kagan and Hillary
Kagan having served on an advisory council for Goldman Sachs?

Hillary having served for six years on the board of Walmart?

Who would be disqualified?

Isn't this a ridiculous litmus test given what we know about each of them?

Speaking of a disqualifying factor, Glenn Greenwald's support for Citizens United should disqualify him from going near the court.

1. HRC has been quite clear that she's not interested in being a judge
Given that, the choice by default would be Kagan.

Try again.

4. Is a legitimate hypothetical.
The point it makes is right on target.

Perhaps it is you that should try again, that is in try reading the OP again.

16. So, you think it means a lot that the crowd joins you in
missing the point of the OP?

I see, you find comfort in crowds and not in accuracy.

20. It has nothing to do with the text.

It has everything to do with the readers' failure to comprehend because of preconceived notions. In essence, they are defensive and/or have agendas.

Nice try, I know, I know, the other kids are doing it. If they jumped from a bridge you would do it too.

21. Yes, of course, the reader is at fault
If only I had the brilliance to tease out the subtle meaning of the writer.

5. I read her comment.
That's why the title states "hypothetical."

I say appoint Oliver Wendel Holmes for a second term.

18. The hypothetical may include
Kagan. After all, Obama hasn't announced his nominee.

3. She got $10,000 from golman sachs. Doesn't sound like she did much with them.
People should look at her career as a whole.

7. I want the love child of Bernie Sanders and Janeane Garofalo put on the court.
Send them to a lab post haste. As soon as there is a viable embryo, name the child Justice and let them begin to serve.

9. Ginny teabaggin' thomas supports citizens united..
too.

The interesting people don't.

I know complainers don't look at the whole picture of someone's record so I don't really care what they have to say about Elena Kagan.

14. Actually, I think it's hilarious.
When you overplay it, it becomes petulant and ridiculous, and backfires into pure comedy gold.

15. Oh please,
"When you overplay it"

Yeah, that only applies when it's something that gets under your skin. Go to page one of this forum and see all the "overplay" that doesn't seem to bother you.
