Kagan and Don’t Ask, Don’t Tell

In 2003 when Kagan became the dean of Harvard Law School, “Don’t Ask, Don’t Tell” — a policy that bars openly gay men and women from military service — was a hotly contested issue on campus. Feeling that the military’s ban on openly gay soldiers violated the school’s anti-discrimination policies, in 1979 the law school barred military recruiters from using their main career services offices for recruitment. But in the 1990s, Congress passed a law — called the Solomon Amendment — that would deny federal funding to any university that did not allow military recruiters access to its campus.

1. What this tells me about Kagan is that she is willing to take a stand when taking a stand is tough
2003... we are going into Iraq.. the whole country is on a drumbeat for war..

She took a stand against the military.. to support DADT.

4. She didn't set the policy, she defended an existing anti-discrimination policy
until it cost her money.

BTW, she is defending DOMA in her role as Solicitor General. If she was that principled in 2003, shouldn't she be principled in 2010?

5. Her job was to do what was best for the school.
Not sacrifice its well-being for a political cause.

8. She did more than anybody else ever fucking did in reference to DADT
up to this point and that was back in 2003.

That was a huge fucking deal. War had just started, and she told
the military to kiss her ass.

What in the fuck did you do in 2003 to help the Human Rights cause
that made a difference? That's what I fucking want to know.

14. Over 300 million dollars.
That's what was on the line, whether *all* federal dollars could be with-held from Harvard (not just the law school), due to a congressional law over allowing military recruiting on campus.

9. Do you know Kagan's personal views on Citizens United?
I don't, and neither is anyone else in DU. Kagan's argument and brief in Citizen United are not her personal views, anymore than her defence of DOMA is. As Solicitor General she is representing the government's side.

It ain't always about what YOU know...it's about what the one
we elected to make these choices knows about what she knows.

17. Kagan was on the short list in 2009 also.. so I am confident the President

20. Yes that is exactly what I meant...
I can see how that is misread.. :hi:

She took it all the way to the Supreme Court, which will be conveniently ignored by some who just are going to go anti Obama on everything...And the right is gearing up to royally roast her over a roaring fire of hate.

I wonder how many will come to her defense?
