2. Yep, this was one big FU to Arlen
He was desperately trying to hang onto his "conservative" street cred when he voted against her for Solicitor General and he's going to have a very tough time voting for her to serve on the SCOTUS after voting against her arguing cases before the SCOTUS.

The timing on this for him is about as bad as it could get.
Seems like the Obama administration didn't give a shit about this
or didn't bother considering it. That's most likely good.

Indefinite detention without trial

At her confirmation hearing, Kagan also drew criticism for arguing that battlefield law, including indefinite detention without a trial, could apply outside of traditional battlefields.<24> The New York Times paraphrases Kagan as saying "that someone suspected of helping finance Al Qaeda should be subject to battlefield law -- indefinite detention without a trial -- even if he were captured in a place like the Philippines rather than a physical battle zone."<25>

If Kagan is voted down, Obama will move to the right on the nomination.

that is... the claim that she is a liberal. I might have agreed with
you a year ago - but I've weaned myself of your type of pragmatism.

10. I believe Arlen Specter will use the "I was a Republican" defense.
He voted against her in March 19, 2009, when he was a Republican.

However, in April 28, 2009, he announced he was switching to the Democratic party.

Thus, the "I was a stupid Republican then" defense.
