I am still undecided about Elena Kagan.
Straight, Gay, I don't care which way she swings. But what does scare the hell out of me is Justice Stevens is leaving one hell of a big pair of shoes to fill when it comes to civil rights especially those of the GLBT community.

This vacancy will have ramifications for years to come no matter what the outcome.

2. I'm interested in her opinion on the recent SCOTUS ruling
about the dude that died in prison from dick cancer.

I believe if you take away someone's ability to seek life-saving healthcare by detaining them, whether in prison or in the pursuit of immigration law, the state is OBLIGATED to provide healthcare themselves. Not so said the SCOTUS in a unanimous opinion two weeks ago.

So I guess I really don't care who replaces Stevens, since he was part of that indication of our current national ethos.

She is not replacing a far left liberal or even, really a liberal. She is a left leaning moderate (maybe) or a moderate replacing a moderate. Nothing much will happen, even in the worst case scenario.


In my imagination, in Obama's second term he is allowed another nomination to SCOTUS, and since he won't have the pressure of re-election, he nominates a real solid liberal, not even a leftie, but a liberal. In the other half of my dream, we have regained a couple of seats in the Senate, and it won't be such a challenge to get a liberal through the nomination process. Then suddenly we will be 5-4 with
a NON-conservative tip. That would help, although it is just a dream at this point.

4. i figured out obama's genius last night.
unless a conservative on the court dies or retires, a liberal is not gonna change things. a pic that moves kennedy away from the rite will actually DO SOMETHING to block alito and and the terrible twins clarence and scalia.
