1. shrug -- they have to respond to it.
and it seems there is a magical number of lower courts that would have to rule against dadt to really impress in this case.

and yes -- i suppose they are trying to work it out through the executive and the legislative -- color me skeptical if i think any of it is vigorous.

2. OP premise wrong.
Brief does NOT oppose lifting DADT, but opposes addressing the issue here, in this case, because it would 'foreclose litigating the issue in other courts.'

Its a legal/procedural matter in this particular case. and in that respect, it makes sense.
