Virginia Judge Rejects Challenge to Health-Care Law

Virginia Judge Rejects Challenge to Health-Care Law

By Margaret Cronin Fisk

A federal judge dismissed a lawsuit in Lynchburg, Virginia, challenging the Obama administration’s health-care overhaul.

The suit, brought by Liberty University, a Christian college, and five individuals, claimed the health-care reform law didn’t protect against mandatory insurance payments being used to fund abortion coverage. They asked the court to find the law unconstitutional.

“Plaintiffs fail to allege how any payments required under the act, whether fines, fees, taxes, or the cost of the policy, would be used to fund abortion,” U.S. District Judge Norman Moon said today. “The challenged provisions of the act are well within Congress’ authority under the Commerce Clause” of the U.S. Constitution, he said in a 54-page decision.

The lawsuit is one of several challenges to the health-care act, including a lawsuit filed in Florida federal court by 20 states. A separate action filed by Virginia Attorney General Kenneth Cuccinelli is before a federal judge in Richmond.

1. I don't want my mandatory insurance premiums to pay for boner pills.
I should take a firm stand on this, and sue.

No matter how hard things get for me.

4. What about helping to prevent your neighbors five year old from being denied health insurance?
If we healthy folks pitch in, then there will be less of a burden on the folks who fortune hasn't been as kind to.

We're American progressives, we believe in watching out for one another ... dont we?

3. finally
not that the challenge had any chance in hell of success...Cuccinelli is just trying to win political points with the nutbars...

and as an aside, FUCK all Virginians who couldn't be bothered to vote and allowed this lawsuit-happy megalomaniac make the rest of the Commonwealth look like a bunch of mentally-crippled bumpkins...

5. Might want to read this again -
- as this ruling is about a different case that doesn't involve Cuccinelli. The suit filed by the Commonwealth of Virginia hasn't yet been heard.
