49 Republicans have asked the House Judiciary Committee to look into Supreme Court Justice Elena Kagan’s supposed prior role in devising a legal defense of President Obama’s health care overhaul, in hopes of warranting the justice’s recusal from hearing any future cases related to the law.
The Republicans’ letter to the committee, released last week, asserts that Department of Justice emails demonstrate Kagan “actively participated…in formulating a defense” of the health care law when she served as the administration’s top lawyer, the Washington Times reports.
Various legal challenges to Obama’s health care law are pending in the legal system, and many predict the Supreme Court will eventually rule on its constitutionality. As a result, politicians from both sides have been calling for justices’ recusals in health care overhaul cases.
For instance, many Democrats have insisted conservative Justice Clarence Thomas step down from health care-related cases due to his spouse’s paid lobbying job against the law, the MinnPost reports.
