In the ongoing battle over...
the TSA, many here on DU have claimed that they haven't "waived" their 4th amendment rights by purchasing a ticket on an airline.

Actually, they have. For example, see rules 35 and 40 on Delta Airlines Contract of Carriage. You can access it by going to Delta's website and clicking on the "Domestic General Rules Tariff".
