16. Plaintiffs Dean and YCR reallege and reaver the allegations of paragraphs 1 through 15 of this complaint as if fully set forth herein.

17. As set forth above, Defendants, jointly and severally, made false, misleading and defamatory statements about Plaintiffs, published these statements to third parties, the Defendants statements were made with malice and at least were negligent, and these statements are actionable as a matter of law irrespective of special harm, but indeed did cause Plaintiffs, each and every one of them, special harm.

18. Plaintiffs sustained and pray for actual and compensatory monetary damages to compensate them for the lost business, loss of good will and reputation as a result of Defendants’ actions, plus punitive damages and attorneys fees and costs, in an amount in excess of $50,000,000.00, and such other relief as this court may deem just and proper.

6. Thank you... Frankly, i don't think Maddow has much to worry about...
Klayman is an asshole RW lawyer that has had some successes, but playing back someone's own words on tape as well as his own qualifiers, is hardly defamation.

were more successful, is it essentially that the defendants cited Dean for:

"But recent controversial statements by Dean – that Muslim countries calling for the execution of gays and lesbians are ‘more moral than even American Christians’ – have drawn the ire of some both within and outside the party.”

~and~

"Birkey’s article also maliciously sought to falsely implicate Plaintiffs in Internal Revenue Service tax issues. Prior to publishing these statements, Defendants the Minnesota Independent and Birkey were advised by Plaintiffs, and these Defendants knew that Plaintiffs did not advocate the execution of gays and lesbians."


Regardless, do you think this has legs? I'm guessing no, unless the judge is a Teabagger (and really, what Teabagger has a law degree? :shrug:)

The fact that in the lawsuit he wants to claim he did not mean what he said is irrelevant. This suit is the first reaction of the very nervous hate preaching anti gay crowd. The invective and calls for violence from so many of them are becoming very unpopular, especially after Norway. The McClurkin types who call for war on gay people, who call us child killers and urge violence toward us are suddenly very nervous, because most humans do not agree with them, and many slowly start to substitute the word 'gay' with names for other minority groups and they understand that a person who was saying that 'Asians are vampires they try to kill children, we must go to war on them for that' is a pure and unadulterated bigot of the KKK level, and that it is the same for those who attack any minority group. Religion or 'tradition' is not an excuse nor a mitigating factor. There is nothing that makes hate speech alright, no minority 'deserves it' and no member of the majority has the right to engage in it.
The hate industry is in a panic. Their product is now seen as blood soaked and vicious. Their days are numbered.

5. Truth is an absolute defense
If there is a record of this asswipe saying these things, and I am sure Rachel and MSNBC made damned sure there was/is, he will be lucky not to get hammered for court costs and defendants' attorney fees. I wonder who the dipshit is that is representing this piece of human sewage.
