Jewish war vets sue to remove war memorial cross from public lands.

"Reporting from San Diego and Los Angeles — The 43-foot cross atop public land on Mt. Soledad in San Diego is an unconstitutional “government endorsement of religion,” a federal appeals court ruled Tuesday, the latest twist in a two-decade legal struggle. But the U.S. 9th Circuit Court of Appeals did not order the cross removed, as the Jewish War Veterans and other litigants, backed by the American Civil Liberties Union, had hoped. Instead, a three-judge panel sent the case back to a federal trial judge for “further proceedings” on the issue of whether the cross can be modified to “pass constitutional muster” as a war memorial, wrote Judge M. Margaret "

4. Hmm. I lost a rec but no reason posted as to why.
Every time an atheist or an atheist group challenges religious symbols on public lands, I'm going to post the link in the OP (there are dozens of other examples of minority religions basing a case on the First Amendment... many have been successful).

Report that a Jewish group makes a First Amendment challenge, and it is crickets here. Report that an atheist group does similar, and out come the Christian apologists to proclaim what idiots atheists are.

5. This is but one more case regarding the cross
it is a long standing issue. It has been ordered removed a few times too.

9. Yes, but when atheists bring such lawsuits, there are regularly characterized
as "hurting the cause", "wasting their time" "causing spiritual harm". You see no such responses in regards to Jews bringing similar lawsuits.

12. Well since this is one of those local cases
that I follow... I expect the fire in real life... to be honest... I even expect a few swastikas at prominent Jewish institutions.

13. "I'm an atheist, but
I don't see a problem here."

That's a popular one on DU.

14. It's a similar mindset that allows the erosion of the Fourth Amendment (eavesdropping...
secret warrants, stop & search, etc.) Everyone seems so secure in their self-righteousness that they forget to be righteous on the behalf of others.

25. This Mt Soledad thing has been going on for 10 years or more, right?
Edited on Sat Jul-30-11 02:15 AM by Mimosa
It was a pitiful old small sticky cross. Oh, 29 feet tall.

http://www.ohioverticals.com/blogs/akron_law_cafe/2011/01/the-mount-soledad-cross-case/

Whoever started making a big deal of it was just stirring up much ado over very little and alienating lots of people for NOTHING. It's sad. The stick looking cross was there for 50 years. It's sort of in NOWHERE. Why even care?

6. Ouch. The teapers aren't gonna like this.
I mean, they just LOVE the Jews so much! It's obvious these aren't "real" Jews, 'cause "real" Jews love Jesus!!

8. They had better watch their backs. Atheists do this and
the death threats come out. I have always felt sorry for religions other than Christians in this country. We act like they do not exist when we pray/memorialize/erect crosses and nativities.

15. If DU's reaction to similar lawsuits brought forward by atheists, then Jews better watch their backs
on DU.

Oh, they'll be no violence threatened but certainly, a fair amount of DUers think that these kind of lawsuits brought on by atheists are newsworthy. I see no OPs when Jewish organizations bring these lawsuits forward.

But then again, there is so much debt ceiling hoopla today that I am not sure what to make of it. Could be everyone has used up all their indignation.

20. This thing has been dragging on for 20 years. And it will likely never end.
I'm dismayed that these people have nothing better to do than to fight over a symbol.

22. I can respect that.
And I'm thinking I know why. I am thinking that you object that I am using this case to support cases filed by atheists.

Correct me if I am wrong.

I object to your comments which seem to imply you desire to see anti-Semitism or animosity directed at Jews because you see the same directed at atheists.

26. I can appreciate that and would agree.
However, your method is flawed. Ironically, the OP to which this thread is a "response to" is known for do something quite similar; evoking Jews and our treatment. And, so we are clear, I am quite aware of bias and bigotry directed against atheists, but it is also leveled against Christians, and trust me, Jews get here more often than you and many think, they just don't call us "Jews."
