I counted more than 41 nays. This needs 60 to pass. I don't think it will make it.

This is the Reid bill being filibustered by the Republicans.
We've long moved past this point since there is a new deal in the works. This is the Democrats making a political statement.

I think perhaps you confused this with 60 votes needed to end a fake Republican procedural "filibuster".
Of course, Senator Reid has the power to immediately end such phantom Republican filibusters by simply withdrawing his "two-track" Senate debate procedural rule and/or forcing a real Senate filibuster on the Senate floor.
That's what Republican Senators will surely do to end Democratic procedural "filibusters" if they regain formal control of the Senate in 2012.

(in fact Chuck Todd said that Reid himself will vote nay if it's needed) so then they can immediately vote on the New! Improved! deal.
I'm assuming the Part Deux bill will be voted on immediately after the defeat of Reid's initial bill?

Reid, Manchin + Nelson (ND) voted nay. and Sanders.
