Occupy Jail Cells
Last night I was arrested for the first time. Why? Because I took part in Occupy Wall Street by showing up to document this historic event. I'm only one of over 700 that were arrested. I can't speak for everyone there, but I can speak for myself. What follows is my account of what happened yesterday afternoon along with photos that I took during the march. But first let me preface this by saying that while supportive of the Occupy Wall Street event, and inspired by the actions of ordinary people standing up to demand an end to corporate greed and corruption, as a busy student I was not "mobilized" into action. Yesterday's actions by the NYPD, however, have turned me into one pissed off and mobilized person, as I'm sure it has many.

Both my boyfriend and myself have been following the events at Zuccotti Park and the Occupy Wall Street movement. I've admired from the sidelines as people have stood up for their beliefs, something I'm ashamed to say that I haven't done very often lately. Yesterday, we decided to head down to the park and take part in the march in order to document it. We both grabbed our cameras and headed out, arriving at the park around 3:30pm. By that point the march had started, and we ran ahead several blocks to beat the march in order to take photos of the lead. We took our photos and then began to move around and among the crowd to gather more images.



Soon the crowd cross the street towards the Brooklyn Bridge. As they crossed, people began to become confused about whether to walk on the pedestrian walk-way or the street. The group split into two, and kept marching. We chose to take the pedestrian walk-way at first. As we looked down to the street, we saw that the police were seemingly leading the protesters to the street in order to keep them safe (or so we thought). At that point, we opted to go back onto the street rather than continue of the pedestrian path.



As we went into the street we heard no warnings at all, none. As you can see in http://www.youtube.com/watch?v=Vz67fULXc-0">this video, police are ahead of the marchers, seemingly leading them. No warnings are shouted. Warning may have been made to these leading in the front of the crowd, but no warnings were made to the mass of the people. Many were confused and were told nothing by the police officers that were in the middle and rear of the march. Also, in http://www.youtube.com/watch?v=FSf7JzpD7kg">the video posted by NYPD that they claim shows that they warned protesters that their marching on the bridge was illegal, you can clearly see that the video was shot when protestors were already on the bridge. In fact, at this point the protesters had already been netted in with orange nets, preventing from "dispersing" as they were telling us to do. We were in the back of the crowd by this point, where the nets were first put in place.



At this point people began to line up in order to leave the bridge willingly. The officers were only letting about five people at a time leave. Several minutes passed and suddenly they quit letting people leave. A white shirted officer began to shout to the rear of the crowd, "You wanted to stay! Now you're staying! You're all getting arrested!" Many people in the rear of the crowd began to freak out - many were crying and begging to leave willingly.

I contemplated what to do. In my mind it would be better for me to willingly turn myself in so that I could leave sooner and show that I was not resisting arrest, and explain that I was there to document and take photos. I was then yelled at by the same white-shirt that yelled at the crowd earlier, "You wanna go in? Ok, then step right up", as if I was insincere about my willingness to go in.



So I stepped up. I was put against the railing of the bridge, searched and then cuffed with plastic zip-ties. The cuffs would come back to bite me. I was then place in a van along with six other females who willingly turned themselves in and we were driven to several different places before being taken to a Precinct with room for us - or so they thought. We sat in the car for over two and a half hours before being taken inside. During this time my arresting officer agreed with me that my cuffs were too tight, and after having them on for about two hours he cut them and placed new ones on. My hands were numb by this point, my wrists blistered and bruised, and my right hand was purple.

Finally we were taken inside where we were again searched, all of our personal property seized, and I was put into a cell made for one person with two other women. We remained there for over six hours. Keep in mind that during this eight hour plus ordeal we were not given food or water. We were not told what was going on, and allowed no phone calls.

I turned myself in at 5pm, immediately after calling my mother to let her know that she wouldn't hear from me for what I thought would be "a few" hours tops. I left the police station and finally called her back at 1:56am, pissed off, angry, hurt, and traumatized from the whole experience. I walked home from the station at which I was held, calling frantically to see if my boyfriend, who was also detained, was out yet. It was 45 minutes later that he was released.

I have a court date in November. I can choose to either pay a small fine and plead guilty to "obstructing vehicular activity" and "disorderly conduct", or show up to court in order to dispute the charges. I plan on showing up, and I plan on disputing.

In the end I'm glad I was arrested. This event has sparked something in me that's been lacking since I came to university and busied myself with schoolwork and internships. I'm passionate about fighting for my country again, and I don't plan on keeping silent.

The police may have tried to deter us, but instead they've impassioned us.

I am one of the 99%, and I'm mad as hell.

I think I'm too old at this point to be put in the paddy wagon. I'm so proud of everyone who is doing this.

I've been to protests before but this one is the real thing.

It doesn't have the same meaning of people vs police that it did back in the 60's when so many were dragged off to Viet nam.

But in some ways, this is almost worse, because they've taken over the entire country, the economy, and are targeting the poor, the old, the sick, and children. At least in the 60's, regular people were innocent and uninformed enough to believe that we had to keep southeast asia out of the hands of the Russians.

This time, there is no real cause except personal greed and lack of human compassion.

So, all of you are stating the real cause, american democracy, and shedding light on the fact that this time the other side has no cause. The other side has planned and carried out an intentional, systematic, and deliberate campaign to rob the middle class of the american dream.

You are all so brave. You are true patriots!

I don't mean, of course, that you were not detained. I believe every word of your story.

Technically, however, being arrested in New York City means that you are booked, which means you enter the system at one of the Central Booking jails, and either wait there for arraignment or, if there is no room in the holding pens, get a transfer to either one of the Houses of Detention or Riker's Island to wait for your arraignment (much more likely for a serious crime arrest on a Friday, given that arraignment probably won't happen until Monday morning).

What happened to you was this: you were issued a Desk Appearance Ticket (we used to call these "a summons," or, if you were just going to ditch the court date, a "disappearance ticket" (haha!)). The police can issue Desk Appearance Tickets (DAT) in one of two ways. They can issue the Desk Appearance Ticket at the scene, or they can remove you from the scene and issue the DAT at the precinct house. The second method - which is usually only instituted if the person is causing some sort of disturbance at the scene - is what happened to you. You were not booked, and, in fact, the court you will go to in order to dispute your DAT is the most minor of "criminal" offices, since the charges against you are not even technically a misdemeanor, but a "violation." Indeed, in Queens the violation court is not even in the main courthouse building, but in a smaller building on the courthouse campus where they also issue the marriage certificates (I'm not sure of the situation in Manhattan). So, in that court, you will wait in a room with dozens of others, facing charges like turnstyle jumping, open alcohol in public, and the Giuliani era favorite "in the park after dark." People will have their names called, and will go confer with a "defense attorney" (who is really just pro forma) for about 30 seconds. The prosecutor will have seen your case file just in the last minute or so. Most likely, the prosecutor will recommend a small fine or "release" without penalty. The judge will ask you for your story, and will likely dismiss within 2 minutes. It won't be high drama, I assure you.

I know, of course, that you feel like you've been arrested, since you were handcuffed and detained and put in a cell. I've been through all three versions growing up in NYC:

1. DAT on the scene
2. DAT at the precinct
3. Arrest with booking (Queens Central Booking).

I can assure you that you were not arrested in the sense of #3, truly entering the system, which makes this little adventure, terrible as I'm sure it was, look like a stroll in Central Park. One of the upshots here is this: for the level of charge made against you, the police could have just issued you a DAT at the scene and let you go. Since you were not booked, there was not technical reason to transport you to the precinct, much less to hold you for seven hours. They did this more or less just to punish you, piss you off, or break your solidarity. The DAT itself can be written in 30 seconds, and probably was.

Good on you, in any case. If you've been to jail for justice, then you're a friend of mine!

Glad it won't be on my record, but will dispute the charge none-the-less. :)

They might not have legally arrested me, but they detained me for a long enough amount of time that it's ridiculous to consider it just detaining and given a summons. Craziness!

48. Indeed...a person on a residential burglary could easily have done less time
Seriously. If somebody gets caught on a residential burglary, they would go to the precinct, and then the next van to Central. That could take as little as 35-40 minutes. If it's a quick arraignment schedule, they could be booked and arraigned and bonded in 4 hours or less. Of course, that's not likely to happen, since people doing residential burglaries usually have a string of priors and don't have the access to funds necessary to bond out that quickly, but it could happen in principle, and probably has happened. Ditto for a whole line of Class A misdemeanors and even felonies.

So, yes, it's quite likely that you spent more time in custody than even some fairly serious criminals.

Making you wait in the car for two hours was pure power play. It was totally unnecessary and done just to punish you.

2 cups of water and let it sit for 5 minutes.
Add approximately 4 TBS of leaf or root and let it seep
for an hour.

Strain the mixture and let it cool.
Apply to your wrists and wrap with gauze wrapping
and sleep with the poultice overnight.
You'll be amazed with the result!

62. Great post. The YouTube video showing the police directing the
crowds and encouraging them to leave the pedestrian bridge and go down on the street to be kettled backs up Ava's report. It's right there on a video. You can see this fat police officer acting like a drum major leading the protestors forward as the police proceed the marchers and then turn around, face the protestors and start arresting them.

For shame on the New York Police Department. Arresting all these people was a waste of manpower and city resources.

The police probably wanted to identify everyone including those who had outstanding warrants and whom the police might be able to persuade to turn into informants or worse.

I hope that I am very pessimistic, but I believe that now, the protestors are going to have to videotape everything and watch out for agitators and informants. The police have ID'd the group for some reason.

The NYC police seem to think a large crowd enjoys being penned in like cattle, which don't enjoy it either. I was at an anti-Iraq War rally in NYC in 2004 and couldn't move an inch for about 4 hrs. due to the cattle gates they used while the crowd gathered for the march. :grr:

Funny thing was, after wriggling my right hand around a little, I realized that I could get out of the cuffs at any point. In the end I decided not too, lol. So I endured the pain of them digging into my wrists for a while longer, but not as long as you had to.

Flexicuffs are not comfortable. In a strange way, they're kind of considered "sissy" handcuffs, but in reality they hurt far worse and dig into your skin much more than the steel ones do. One of my biggest fears whenever I engage in civil disobedience is that I have an asshole officer that puts my cuffs on too tight and refuses to take them off for a long time. That kind of thing can cause permanent nerve damage.

Anyways, good job and welcome to being a part of the long, rich, rigorous, and honorable tradition of getting jailed for justice!

you naughty little monkey you. You are the same age as my little trouble maker. She hasn't been arrested, but she has opened up her first can of whop ass.

I am so proud of you (and worried about you). I am so proud off all of you on Wall Street. I have enjoyed Uncle Sam's hospitality too. Leaves a bit to be desired. While unsettling, it is not as bad as it could be and is in other countries. Things like this do tend to make you more radical. Keep up the good fight and know that we are all so proud of the person you have become.

Regardless of what happens with Occupy Wall Street, this has shown the NYPD to be just as, if not even more corrupt than the traders. Your charge, even if it were true, which I believe it is not, did not warrant their physical and psychological abuse.
