Burglars Report Man's Child Porn
(CNN) -- A central California man has been arrested for possession of child pornography, thanks to a tip from burglars who robbed the man's property, authorities said.

Last month, a juvenile and a 19-year-old illegally accessed the property of Kraig Stockard, 54, of Delhi, California, according to a statement from Deputy Tom MacKenzie of the Merced County Sheriff's Department. They broke into Stockard's barn and stole approximately 50 CDs they believed were blank.

Stockard filed a police report on the incident on September 12, according to MacKenzie.

But the young people who stole the CDs were in for a surprise. When they began putting the discs into their computer, they discovered that some of them contained pornographic images of children, the statement said.

Despite having obtained the CDs under decidedly shady circumstances, the pair decided to report Stockard to the police.

4. I wonder if the evidence could possibly be thrown out in court

5. The state did NOTHING to violate his rights
If the state instructed the burglars to rob the house, it could be thrown out. However, under these circumstances, nothing will get thrown out.

8. I wonder why the guy even reported the CDs stolen?
I wouldn't think he'd report a break-in knowing what was stolen...

12. Doesn't matter one bit
Assuming it can be shown that it came from his house, it is all fine. Something similar happened here a few years ago, except it was a computer that was stolen and it was sent to the police anonymously. Again, the state did NOTHING illegal & did not instruct anyone to do anything illegal.

11. Nope, I read the rest of the article, the cops used the stolen cd's to get a warrant, and then...
found lots more porn on the computer hard drives. This one will hold up in court.

were not violated by a state actor.

14. Law does a great deal with this sort of thing all the time.
Computer techs reporting what they find on computers put in for repair.

Thieves pinching computers and then handing them in when they find the porn.

"found" evidence is not subject to the same rules as "collected" evidence.

9. This is how Andre was caught as a spy during the Revoluion,
Andre had a Pass signed by Benedict Arnold, thus went through American lines without being searched. Then he was waylaid by two armed robbers. The thieves demanded he remove his boots, knowing many kept their valuables in their boots. What the thieves found was the Plans for the Defenses of West Point, which was the main block against any British move up the Hudson from New York City.

The thieves turn over the plans and Andre over to the local authorities. He was tried and convicted of being a spy, for he had been in Civilian clothes. Benedict Arnold on hearing of Andre's arrest, left his Headquarters at West Point for the British lines in New York City.

Andre was hanged. The British Command asked for a Prisoner Exchange, but they had hanged Nathan Hale the previous year AND the only person Washington would accept was Arnold (Who Washington wanted to hang or the same crime).

Wikipedia gives the name of the three Americans who captured Andre and said they were on a Patrol. Andre said at his trial they were robbing him, and most of the people at that time also thought so, but their refusal of Andre's bribe, and they were willing to undertake the risk of being executed for robbery to turn over the plans and Andre to New York State Authority.
