Herman Cain Abortion Amendment: GOP Candidate Makes Constitutional Error

Herman Cain may not think it's important to know who the president of Uzbekistan is, but he might want to brush up on his knowledge of the constitution.

The GOP candidate told Christian Broadcasting Network that he would sign a constitutional amendment banning abortion.

"I feel that strongly about it. If we can get the necessary support and it comes to my desk I’ll sign it. That’s all I can do. I will sign it," he said.

Unfortunately for Cain, as Politico's Ben Smith points out, the president doesn't sign constitutional amendments. In fact, he plays essentially no role in the process.

on a constitutional issue and doesn't make an error, then that would be news.

Recent statements by Gingrich, Santorum, Bachman, Perry, and Paul among others have persuaded me that not one really knows much about, or cares much about the Constitution.

3. it'll never get passed in the required 2/3 of the States.
States in which it will not pass, off the top of my head:
NY
MA
VT
RI
CT
NJ
NH
CA
OR
WA
MI
WI
DE
NJ
HI
MD

There has to be 4 more, but these I am almost certain will not pass it.

7. The requirement is 3/4, not 2/3.
Congress can propose an amendment only by a 2/3 vote in each chamber, but once it goes to the states, it needs the approval of 3/4 of them.

Of course, this only amplifies your point. The whole amendment thing isn't a serious proposal; it's raw meat to be thrown to the opponents of reproductive rights.

So I guess that the states that I mentioned would be a solid block to such an amendment.

11. Brilliant answer when you think about it.
What he really wants to say is like the president before him and the president before that and the president before that and the president before that, he's not going to do anything about abortion rights. But he's got to appease the religious extremists. So whats a better way to do that than to seemingly make a mistake about what he's capable of doing?

13. They really can't afford to do anything about abortion rights.
They can make some noise and threaten to outlaw them, but if they do, they will lose some of their single issue voters.
