Arizona can't declare Giffords' seat vacant

Matthew Benson, a spokesman for Arizona Secretary of State Ken Bennett, told Capitol Media Services that a state law that allows a public office to be declared vacant if someone is absent for three months "doesn't apply to federal offices."

The issue was raised in a report by The Washington Post on Monday. That story implied that Giffords was in danger of losing her seat, according to this report on the website of radio station KTAR.

Giffords, an Arizona Democrat who is in her third term in Congress, was shot at point-blank range on Jan. 8 as she met with constituents outside a Tucson grocery store. Six people died in the shooting rampage.

Benson said a vacancy for Giffords' 8th District congressional seat could only be declared by the U.S. House of Representatives and "not the state of Arizona."

6. Washington Post is not a reliable source.
For example, (according to a friend of mine who receives their email alerts), they initially sent an email alert that Giffords had died. They issued another alert saying that she was in surgery, but never retracted, or apologized for, or even acknowledged the mistake.
