Children of Illegal Immigrants Sue Florida Over State’s College Tuition Policy

MIAMI, Fla. (CBS Tampa) – Children of illegal immigrants living in Florida are suing the state for charging them out-of-state tuition.

Wendy Ruiz, a sophomore at Miami Dade College, is one of those behind the lawsuit. She is paying $5,000 more than she technically has to, because her college insisted upon charging her out-of-state tuition when her parents were unable to produce legal immigration documents.

Ruiz was born in the United States, and has lived in Florida her entire life. As such, she is both an American and Florida citizen in the eyes of the law.

“It’s so unfair,” she told CBS Tampa. “I was born here. This makes no sense.”

Rather than keeping quiet, Ruiz chose to take action. She and five other college-age Floridians are now involved in a class-action lawsuit that seeks to overturn the rule.

Point 1

If they are legal US citizens, I do not see how they can be treated differently. This appears to me to be a direct violation of the due process clause.

Point 2

If a person is illegally in the country (as defined under current national law), then I don't see how they can go on being allowed to stay in the US, let alone go to any university, if America is to continue on as a soveriegn nation.

Point 3

You either have rule of law or you do not. It is not pick and choose. If enough people disagree with the current immigration law, then it needs to be changed via the proper legislative process. If it is not changed, and one group simply ignores this set of laws, then they forfeit the right to demand to have other laws they favour enforced. The same works for any pet issue of the so-called right or so-called left in America. The systemic controllers use this contradictory sense of enforcement to further divide the nation at a multiplicity of schematic levels. The outcome is losses across the board for everyone but them.

1. They are adults...they can stay. The parents have to go.

2. That doesn't answer the question of why they, as legal citizens and residents of Florida
all of their lives, are being forced to pay out-of-state tuition rates.

4. They should get in state tuition. They are independent.
But their parents are illegally working here and they need to go back home and go through the proper process of gaining entry.

3. punishing the child for the parents lack of info...
She is a legal citizen of the U.S. and Florida, so she should not have to pay out of state tuition based on bogus reasoning from whomever put that rule into effect...

I'm wondering if it was the college or the state who made that call. nt
