The soap opera of my life goes on........
We were nearly ready to complete a mortgage modification several months ago, when at the last minute, Wells Fargo said they didn't want to finish it unless I got a judgment lien (nasty neighbor lawsuit--refer to former posts) removed from my property. It had been discharged against me personally in the Chapter 7 bankruptcy, but remained on the property. I agreed to get the lien removed. Long story short, I ended up having to file a quick Chapter 13 bankruptcy to keep them from foreclosing on me.
I had to hire an attorney to go back in, reopen the Chapter 7, and file a motion to get the lien removed. It's been dragged out some because the attorney for the neighbors has refused to cooperate, even though the judge has already said he's going to approve the motion.
In the meantime, my attorney had to re-do my Chapter 13 and refile it, as the trustee threw a fit when I tried to "cram down" my mortgage. I still don't understand why this couldn't be done when there's a number of sources that say you can. Especially when Wells Fargo is trying to ring $370K out of me, and the property only appraises now for about $250K.
Wells Fargo is now refusing to talk to either me or my attorney. I was dealing directly with the Presidential Offices previously, as a "special" case. I think I was only special because I got Senator Boxer's office involved. They have talked with the OCC (Office of the Comptroller of the Currency, which regulates banks), and Freddie Mac. In the first go round, they appeared to be trying to help me. Today, when I talked with Boxer's office, he said no one can get hold of the OCC anymore, so they don't even try, and Freddie Mac says that Wells Fargo is advising them to foreclose.
At the moment, I still have bankruptcy protection. It is completely unconscionable that Wells Fargo would tell a single woman in the middle of a nasty divorce, who is just trying to hang onto the farm she loves, to go hire an attorney at great expense to remove this lien so they could finish the mortgage modification, if their plan all along was to foreclose.
Any other experience like this out there, or informed advice on other action I can take? I have put my heart and soul into this place, and have horses, donkeys, goats, dogs, cats, chickens, ducks, geese........I can't just jump ship like my ex-husband did. thanks
