Occupy Delaware wins ruling, leading to tent camp
Judge: Free-speech rights were infringedShortly after a Chancery Court judge issued an order Thursday allowing Occupy Delaware to set up camp in Wilmington's Spencer Plaza, the tents began to go up.
"I could kiss the judge," said Meshal Rivera, who set up one of the first tents about an hour after Chancery Court Vice Chancellor Sam Glasscock III issued his order.
The order was to last one day, but later negotiations between Wilmington, the ACLU and Occupy Delaware will permit the protesters to remain in the plaza without need for a hearing today.
Three days before, the city told protesters they could not have an encampment in the French Street lot across from the Redding City-County and Carvel State Office buildings.
Rivera is one of a handful of Occupy supporters who have spent several nights sleeping in the open since Wilmington police told protesters on Monday they could not erect tents in the plaza. Occupy Delaware said prohibiting them from erecting tents violated their freedom of speech, one of their arguments in seeking the temporary restraining order from Chancery Court.*snip*
