SC Governor Nikki Haley Deleting Emails. This is wrong, right?

Under a policy set by the governor’s office, only emails between the governor and the public are being saved and archived permanently.

Other emails that Haley sends or receives — including exchanges with her staff members — are being deleted.

Some say the policy violates the state’s open-records law, meant to ensure the public has access to government records. Because emails are being deleted, they are not available for the public to review.

“If you fail to retain public documents for some reasonable length of time, it’s a violation of (the law),” said Carmen Maye, an attorney for the S.C. Press Association, of which The State is a member.

1. Yes! They are state records and should be saved.

They should not be saved at her whim. I don't think the governor's policy supercedes state law. That only occurs in Haleyland which is next door to OZ. Take the first sharp right onto Muddy Ethics Road.

Her majesty has some more 'splainin to do.

Listening to local news and they claim there was room needed on servers and more gobbledygook.
Translated: we gots stuff on there we don't want people to see.
Call in some experts. They never really disappear.

8. Well, this is happening, or being reported, just as an email is uncovered in a lawsuit vs. Haley.

A lawsuit filed against S.C. Gov. Nikki Haley by former S.C. Board of Economic Advisors (SCBEA) chairman John Rainey may have uncovered the first “smoking gun” on South Carolina’s ethically-challenged, truth averse chief executive.

We suspect it won’t be the last …

Specifically, Rainey’s 160-page lawsuit includes an August 2008 email exchange between Haley and the CEO of Lexington Medical Center – the hospital where the former state lawmaker was employed as a “fundraiser” from 2008-2010.

Asked about the status of the hospital’s effort to secure certification for a new open heart center (which obviously has nothing to do with fundraising), here was Haley’s reply:

We have some work to do not only to switch votes but to hold the ones we have. We are as close as we are going to get and can’t afford to leave one stone unturned. We were all given assignments and are working on them. Fingers crossed!

The email was not included in the hospital’s responses to Rainey’s various Freedom of Information Act (FOIA) requests – for obvious reasons. It was included, however, as an exhibit in Rainey’s lawsuit against the governor.

3. Who knows what she is hiding?
I think she is corrupt, stupid, and paranoid. With that combination, she could want to hide anything.

The news just said her rationale was that Governor Appalachain Trail also deleted the same type of emails.

Well, that satisfies me. NOT!

BTW in one way or another, she has managed to piss off the entire state. There is some issue or policy that she is involved in that someone could find to irritate them. This includes her erstwhile supporters. That's a pretty remarkable feat.

though it is considered public records since she is in office, I guess she still has a so called right for personal emails

10. Nope!
They are created on state equipment using state systems. There is no protection since they are considered to be state related emails. If they won't protection for personal emails, then they should be using other methods on their own time.

BTW she has also been accused of using staffers' personal cell phones to conduct state business. Her use of government cell phones is so far below the norm that it is believed that she is avoiding any possible oversight.

If she is conducting state business, it should be transparent and available for FOI request.
